PURSUANT to section 149 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to stopping the portions of road described in the Schedule hereto.

Declaring Natural Water to be of National Importance

THE RIGHT HON. J. R. MARSHALL PRESIDING IN COUNCIL
PURSUANT to section 23 of the Water and Soil Conservation Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares the natural water described in the Schedule hereto to be of national importance.
SCHEDULE
- The waters of the Fork Stream.
- The waters in Lake Tekapo, Lake Pukaki, and Lake Ohau.
- The waters flowing from Lake Tekapo, Lake Pukaki, and artificial channels to the points where they discharge into Lake Benmore.

Boundaries of Te Rapa Drainage District Altered

THE RIGHT HON. J. R. MARSHALL PRESIDING IN COUNCIL
PURSUANT to the Land Drainage Act 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER
THE area described in the Schedule hereto is hereby excluded from the Te Rapa Drainage District.
SCHEDULE
ALL that area in the South Auckland Land District, Waipa County, containing 467 acres 2 roods 23.5 perches, more or less, bounded by a line commencing at the northernmost corner of Lot 2, D.P. 27961, situated in Block XII, Newcastle Survey District, and proceeding south-easterly along the north-eastern boundaries of Lot 2, D.P. 27961, and Lot 3, D.P. 36338, to the easternmost corner of that last-named lot; thence westerly along the southern boundaries of Lots 3, 4, 3 again, 2, and 1, D.P. 36338, and part Lot 1, D.P. 5700A, to the eastern side of Whatawhata-Ngaruawahia Road; thence northerly along that roadside to the southern boundary of part Allotment 166, Horotiu Parish; thence north-easterly generally along the generally north-western boundaries of part Lot 1, D.P. 5700A, and Lots 1 and 2, D.P. 27961, to the point of commencement.

The Ohawe Beach and Waihi Beach Foreshore Control Order 1968

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER
- (1) This order may be cited as the Ohawe Beach and Waihi Beach Foreshore Control Order 1968.
(2) This order shall come into force on the date of its publication in the Gazette. - In this order—
“Foreshore” means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides;
“Minister” means the Minister of Marine, and includes any officer, person, or authority acting by or under the direction or authority of the Minister;
“Act” means the Harbours Act 1950. - There is hereby granted to the persons acting as trustees for the inhabitants of the locality and named in the First Schedule to this order (hereinafter called the trustees, which term shall include their successors or assigns, unless the context requires a different construction) the control of the foreshore described in the Second Schedule to this order, subject to the provisions of section 165 of the Harbours Act 1950, and to the conditions specified in the Third Schedule to this order.

Description of Foreshore
ALL that part of the foreshore of the County of Hawera commencing at the south bank of the Waingongoro Stream and extending generally in a south-easterly direction to a point 4 miles distant.
THIRD SCHEDULE
Terms and Conditions
- Her Majesty or the Governor-General and all officers in the Government service acting in the execution of their duty shall at all times have a free ingress, passage, and egress into, over, and out of the foreshore described in the Second Schedule hereto.
- Nothing herein contained shall authorise the trustees to do or cause to be done anything repugnant to or inconsistent with any law relating to the Customs, or with any regulation of the Minister of Customs, or with any provision of the Harbours Act 1950 or its amendments, or any regulations made thereunder that are or may hereafter be in force.
- The rights, powers, and privileges conferred by this Order in Council shall not apply to those portions of the foreshore required for securing the shore ends of any telegraph cables that are at present or may be at any time laid down within the area of foreshore described in the Second Schedule to this order.
- Fees and other charges received from licences and permits that may be issued by the trustees pursuant to section 165 (3) of the Act shall be expended on facilities and amenities for public recreation on the foreshore and adjacent public areas.
