Declaring Land Taken for Maori Housing Purposes and Land and Easement over Land Taken for an Institution Established Under the Child Welfare Act 1925 in the City of Papatoetoe

Pursuant to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, sufficient agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby taken for Maori housing purposes, the land described in the Second Schedule hereto is hereby taken for an institution established under the Child Welfare Act 1925, and the sewage easement described in the Third Schedule hereto is hereby taken over the land described in the Fourth Schedule hereto for an institution established under the Child Welfare Act 1925, from and after the 16th day of September 1968.

Land Taken for an Institution Established Under the Child Welfare Act 1925

Description of Sewage Easement

First the full, free, and uninterrupted right, liberty, and licence for Her Majesty the Queen her tenants, engineers, servants, agents, workmen, contractors, licensees, and invitees (hereinafter referred to as 'Her Majesty') from time to time and at all times to drain, discharge or convey sewage and other waste material and fluid in any quantities along over or under the land described in the Fourth Schedule hereto and for that purpose to lay and maintain a line or lines of sewage pipes through and under the piece of land described in the said Fourth Schedule, and secondly in order to construct or maintain the efficiency of any such sewage pipes the full, free, uninterrupted, and unrestricted right, liberty, and licence for Her Majesty to enter upon the land described in the said Fourth Schedule for the purpose of laying, inspecting, cleansing, repairing, maintaining, and renewing any such sewage pipes or any parts thereof and of opening up the soil of that land to such extent as may be necessary and reasonable in that regard, subject to the condition that as little disturbance as possible is caused to the surface of the land described in the said Fourth Schedule and that the surface is restored as nearly as possible to its original condition and any other damage done by reason of the aforesaid operations is repaired to the intent that such easement hereinbefore referred to shall be forever appurtenant to the land described in the Second Schedule hereto.

FOURTH SCHEDULE

NORTH AUCKLAND LAND DISTRICT

Land over which Sewage Easement is Taken

All that piece of land situated in Block X, Otahuhu Survey District, City of Papatoetoe, North Auckland R.D., and being that part of Lot 4, D.P. 57048, coloured yellow on D.P. 57048. Part certificate of title, No. 10D/1228. North Auckland Land Registry.

Dated at Wellington this 1st day of August 1968.

Land Proclaimed as Road, Road Closed, and Land Taken in Blocks V, VI, and IX, Glenkenich Survey District, Clutha County

Pursuant to section 29 of the Public Works Amendment Act 1948, the Minister of Works hereby proclaims as road the land described in the First Schedule hereto; also hereby proclaims as closed the road described in the Second Schedule, and declares that the road first described in the said Second Schedule shall vest in John Davidson McKay, of Waikoikoi, farmer, subject to memoranda of mortgage No. 156773 and 156774, Otago Land Registry, and the road secondly and thirdly described in the said Second Schedule shall vest in Henry Brown Gow and Alexander John Gow, both of Waikoikoi, farmers as tenants-in-common in equal shares, subject to memorandum of mortgage No. 315238, Otago Land Registry, and subject as to the interest of Alexander John Gow in memorandum of mortgage No. 279189, Otago Land Registry, and the road fourthly and fifthly described in the said Second Schedule shall vest in Charles Cook, of Wendon Valley, farmer; and also hereby takes the land described in the Third Schedule hereto for the purpose of subsection 6 of the said section 29, and declares that the land first described in the said Third Schedule shall vest in Henry Brown Gow and Alexander John Gow, both of Waikoikoi, farmers, as tenants-in-common in equal shares, subject to memorandum of mortgage No. 315238, Otago Land Registry, and subject as to the interest of Alexander John Gow in memorandum of mortgage No. 279189, Otago Land Registry, and that the land secondly described in the said Third Schedule shall vest in Charles Cook of Wendon Valley, farmer.
