IN THE MATTER of the Charitable Trusts Act 1957 AND IN THE MATTER of the Estate of THOMAS CURRIE LIST, formerly of New Plymouth, newspaper proprietor, deceased:
NOTICE is hereby given pursuant to section 36 of the above Act that St. Mary’s Parochial Trust Board a body corporate constituted under the said Act (hereinafter called “the Board”) has applied to the Supreme Court at New Plymouth for the approval of a scheme prepared by the Board under section 34 of the said Act for the disposition as hereinafter mentioned of the property held by the Board pursuant to the Will of the said Thomas Currie List upon trust for the building of a chapel in the vicinity of the New Plymouth Boys’ High School as a place of worship for Anglican pupils of the said School the said trust being impossible or impracticable or inexpedient to carry out for the purposes stated in such trust.
Particulars of the said Scheme are as follows. The property held by the Board as aforesaid upon the trust provided in the said Will shall be applied for the following purposes—
(a) For the purpose of enabling a part of the new assembly hall proposed to be erected at the New Plymouth Boys’ High School to be set apart and used from time to time as may be required as a non-denominational chapel, and for such purpose to provide and install in such part suitable sliding doors, fixtures, fittings, furniture and furnishings.
(b) To invest the Trust Fund and any accretions thereto in any of the investments for the time being authorised by the law of New Zealand for the investment of trust funds.
