  1. The Council may enclose any part or parts of the foreshore described in the First Schedule to this order for the purpose of holding athletic sports or games, and may, by bylaws, fix a charge for admission to such enclosed part or parts: Provided that the total number of days on which such enclosures are made shall not exceed six in any one year.

  2. Nothing herein contained shall authorise the Council to remove or cause to be removed any stone, sand, shingle, or shells without the consent of the Minister being first obtained.

  3. At each of the main public access ways to the foreshore described in the First Schedule to this order there shall be displayed signs notifying that the Council controls the foreshore and that bylaws are in force.

  4. The said rights, powers, and privileges may be at any time resumed by the Governor-General, without payment or any compensation whatever, on giving to the Council 6 calendar months’ notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at or posted to the last known address of the Council in New Zealand.

The Frankton Arm, Lake Wakatipu Lakeshore Control Order 1968

ORDER IN COUNCIL

At the Government House at Wellington this 4th day of June 1968

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.


ORDER

  1. (1) This order may be cited as the Frankton Arm, Lake Wakatipu Lakeshore Control Order 1968.

(2) This order shall come into force on the date of its publication in the Gazette.

  1. In this order—

The Council” means the Lake County Council:

Lakeshore” means the bed of the lake to a distance of 66 feet from the margin of the lake at its ordinary level:

Minister” means the Minister of Marine; and includes any officer, person, or authority acting by or under the direction or authority of the Minister.

  1. There is hereby granted to the Council for a period of 21 years from the commencement of this order the control of the lakeshore described in the First Schedule to this order, subject to the provisions of section 165 of the Harbours Act 1950 and to the conditions specified in the Second Schedule to this order.

FIRST SCHEDULE

DESCRIPTION OF LAKESHORE

ALL that part of the bed of Lake Wakatipu to a distance of 66 feet from the margin of the said lake at its ordinary level commencing at the eastern boundary of the Borough of Queenstown and proceeding generally north-easterly, south-easterly, and south-westerly to the southern boundary of Lake Wakatipu Service Railway Reserve.


SECOND SCHEDULE

CONDITIONS

  1. Her Majesty or the Governor-General and all officers in the Government service acting in the execution of their duty shall at all times have free ingress, passage, and egress into, over, and out of the lakeshore described in the First Schedule to this order without payment.

  2. Nothing herein contained shall authorise the Council to do or cause to be done anything repugnant to or inconsistent with any law relating to the Customs, or with any regulation of the Minister of Customs, or with any provision of the Harbours Act 1950 or its amendments, or any regulations made thereunder that are or may hereafter be in force.

  3. The rights, powers, and privileges conferred by this Order in Council shall not apply to those portions of the lakeshore required for securing the shore ends of any telegraph cables that are at present or may be at any time laid down within the said area of lakeshore.

  4. Commission to Inquire into Organisation of Wildlife Management and Research


ARTHUR PORRITT, Governor-General

ORDER IN COUNCIL

To all to whom these presents shall come, and to:

JACK KENT HUNN, C.M.G., LL.M., of Wellington, retired civil servant;

RICHARD KENNETH DELL, B.A., DIP.ED., D.SC., of Wellington, Director of the Dominion Museum; and

ROLAND FRASER STEAD, of Rangiora, farmer.

GREETING:

WHEREAS it is deemed expedient that an inquiry should be made into matters concerning the organisation of wildlife management and research and matters incidental thereto: Now, therefore, pursuant to the Commissions of Inquiry Act 1908, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, acting by and with the advice and consent of the Executive Council, hereby appoint you, the said Jack Kent Hunn, Richard Kenneth Dell, and Roland Fraser Stead, to be a Commission to inquire into and report upon—

(a) The organisation and control of wildlife management and research:

(b) The most appropriate organisation which in the public interest would ensure—

(i) Co-ordinated advice to the Government on wildlife policy and financial matters relating thereto;

(ii) Adequate, basic and applied research into wildlife and its associated ecology; and

(iii) Efficient and economical management of wildlife policies—

and generally to inquire into and report upon such other matters arising thereout as may come to your notice in the course of your inquiries and which you consider should be investigated in connection therewith, and to report upon any matters affecting the premises which you consider should be brought to the attention of the Government, and in particular, to report your opinion whether any additional legislation is necessary and the scope of the same:

And with the like advice and consent I hereby appoint you, the said Jack Kent Hunn, to be the Chairman of the said Commission:

And for the better enabling you to carry these presents into effect you are hereby authorised and empowered to make and conduct any inquiry under these presents, in accordance with the Commissions of Inquiry Act 1908, at such times and places as you deem expedient, with power to adjourn from time to time and from place to place as you think fit, and so that these presents shall continue in force and the inquiry may at any time and place be resumed although not regularly adjourned from time to time or from place to place:

And you are hereby strictly charged and directed that you shall not at any time publish or otherwise disclose, except to me in pursuance of these presents or by my direction, the contents or purport of any report so made or to be made by you or any evidence or information obtained by you in exercise of the powers hereby conferred on you except such evidence or information as is received in the course of a sitting open to the public:

And it is hereby declared that the powers hereby conferred shall be exercisable notwithstanding the absence at any time of any one member of the Commission hereby appointed, so long as the Chairman and one other member are present and concur in the exercise of such powers:

And it is hereby further declared that you have liberty to report your proceedings and recommendations under this Commission from time to time if you shall judge it expedient so to do:

And, using all due diligence, you are required to report to me in writing under your hands not later than the 1st day of December 1968 your findings and opinions on the matters aforesaid, together with such recommendations as you think fit to make in respect thereof.

Given in Executive Council under the hand of His Excellency the Governor-General this 10th day of June 1968.
