HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

This order may be cited as the Tauranga Borough Council Water Power and Electric Lines Licence 1958, Amendment No. 2, and shall be read together with and deemed part of the Tauranga Borough Council Water Power and Electric Lines Licence 1958* (hereinafter referred to as “the principal order”).

The principal order is hereby amended by deleting the word “borough” wherever it appears therein and substituting the word “city”.

The principal order is hereby further amended by deleting clause 2 of the First Schedule thereto and substituting the following:
“(2) lines for the transmission of electrical energy as follows:
(a) Commencing from the licensee’s powerhouse at Omanawa Falls and proceeding north-westerly generally across Blocks VI and V Otanewainuku Survey District to the licensee’s powerhouse at McLarens Falls, thence two lines proceeding generally north-easterly across Blocks V, I, and II Otanewainuku Survey District and Block XIII Tauranga Survey District to a point on the northern boundary of the said Block XIII, thence a single line across Block IX and X Tauranga Survey District to the licensee’s substation in Tauranga City; the said lines being shown by means of blue and broken blue lines on plan marked N.Z.E.D. 757, deposited as aforesaid.
(b) Commencing from the New Zealand Electricity Department’s substation at Greerton and proceeding north-easterly generally across Blocks XIV and X, Tauranga Survey District, to the licensee’s substation in Tauranga City, the said line being more particularly shown by means of a blue line on the said plan marked N.Z.E.D. 757.”

PURSUANT to the Public Works Act 1928 and the Electric Power Boards Act 1925, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

This order may be cited as the Taranaki Electric Power Board Water Power and Electric Lines Licence 1968.

Subject to the conditions hereinafter set forth, the Taranaki Electric Power Board (hereinafter referred to as “the licensee”) is hereby granted a licence to obstruct, impound, or divert the waters of the Manganui River and the Mangaotea and Mako Streams (hereinafter referred to as “the said rivers”), in the Taranaki Land District, to raise or lower the levels thereof, and to take and use therefrom, for the purpose hereinafter set forth, streams of water (hereinafter referred to as “the said streams”) not exceeding 150 cu. ft. per second at any one time from the Manganui River, 20 cu. ft per second at any one time from the Mangaotea Stream and 5 cu. ft per second from the Mako Stream, and also to lay, construct, put up, place and use electric lines and to construct electric works which may from time to time be required for the distribution and supply of electricity within the areas described in the First Schedule hereto.

The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1967 shall be incorporated herein and shall form part of this licence, except in so far as they may be inconsistent with the provisions of this licence.

This licence is subject to the Water Power Regulations 1934, the Electrical Supply Regulations 1967, the Electrical Wiring Regulations 1961, and the Radio Interference Regulations 1958, and with all regulations made in amendment thereof or in substitution therefor, except in so far as they may be inconsistent with the provisions of this licence.

The said streams shall be taken from the said rivers at the points indicated by orange arrows on the plan marked N.Z.E.D. 765 deposited in the office of the New Zealand Electricity Department at Wellington and shall be used solely for the purpose of generating electricity.

The licensee is hereby authorised, subject to the conditions hereof, to construct, maintain and use the works described in the Second Schedule hereto, the position of the said works being indicated on the aforementioned plan.

The systems of supply shall be as described in paragraphs (a), (b), (c), (d), (e), (f), (h), and (j) of regulation 15 of the Electrical Supply Regulations 1967. The system of supply authorised under paragraph (j) shall be a single conductor earth-return system and the use thereof shall be subject to the terms and conditions laid down by the General Manager of the New Zealand Electricity Department.

Nothing in this licence shall of itself be deemed to confer upon the licensee any right to water.

This licence shall, unless it is sooner lawfully determined, continue in force until the 31st day of March 1989.

FIRST SCHEDULE
AREA OF SUPPLY
THE Taranaki Electric Power District and outer area of such district as described in the First and Second Schedules respectively to the Proclamation dated the 24th day of February 1968 and appearing in the Gazette on the 7th day of March in the same year at page 357.

SECOND SCHEDULE
HEADWORKS consisting of dams and necessary intakes, pipeline, races, or flumes leading directly or indirectly from such intakes to the powerhouse, such powerhouse having all necessary equipment including water turbines, generators, transformers, lightning arrestors, switchboards, switches, exciters, and other appliances for generating electricity.

Amending an Order in Council Authorising the Heathcote County Council to Erect Electric Lines

At the Government House at Wellington this 4th day of June 1968
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 11th day of November 1930 and published in the Gazette on the 20th day of the same month at page 3585, authorising the Heathcote County Council to erect electric lines within the County of Heathcote, as amended by the Order in Council dated the 21st day of September 1938 and published in the Gazette on the 6th day of October of the same year at page 2184, and further amended by the Order in Council dated the 23rd day of July 1947, and published in the Gazette on the 31st day of the same month at page 930 by deleting clause 1 of the Schedule thereto and substituting the following:
“1. Lines authorised—
(1) Lines within the area of supply comprising the Cashmere Riding of the County of Heathcote as at present constituted, the same being more particularly delineated by a coloured red line on the plan marked N.Z.E.D. 737, deposited in the office of the New Zealand Electricity Department at Wellington, and that portion of the Heathcote Valley Riding of the said County as at present constituted which is coloured green on the plan marked S.H.D. 7, deposited as aforesaid.
(2) Two further lines outside the above-mentioned area of supply; one proceeding from the boundary of the supply area in a south-westerly direction along Ashgrove Terrace to its junction with Barrington Street, and the other proceeding in a south-easterly direction from the boundary of the supply area along Sloan Terrace to its junction with Centaurus Road; such lines being more particularly shown by means of broken blue lines on the plan marked N.Z.E.D. 766, deposited as aforesaid.”
