PURSUANT to section 175 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Manukau City Council to reclaim from Turanga Creek at Whitford an area of 1 acre, more or less, as shown edged in red on plan marked M.D. 12856 and deposited in the office of the Marine Department at Wellington.

The Lake Wiritoa Order 1968

At the Government House at Wellington this 27th day of May 1968

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 8A of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council and at the request of Wanganui County Council, hereby makes the following order.

ORDER

  1. (a) This order may be cited as the Lake Wiritoa Order 1968.
    (b) This order shall come into force on the date of its publication in the Gazette.

  2. In this orderβ€”
    "The Act" means the Harbours Act 1950:
    "The Council" means the Wanganui County Council:
    "Minister" means the Minister of Marine; and includes any officers, person, or authority acting by or under the direction or authority of the Minister.

  3. There is hereby granted to the Council, for a period of 21 years from the commencement of this order, subject to the provisions of section 8A of the Act and to the condition specified in the Second Schedule to this order, the control of the waters described in the First Schedule to this order.

FIRST SCHEDULE
DESCRIPTION OF WATERS

ALL that area of water being part of Lake Wiritoa situated in Block X, Ikitara Survey District, containing 43 acres 3 roods, more or less, bounded towards the north-west by Kaitoki Road, towards the south by Crown land and section 476, Left Bank Wanganui River, and towards the east generally by Lot 1, D.P. 979.

SECOND SCHEDULE
CONDITIONS

  1. Subject to the provisions of section 8A of the Act, the Council for and within the area of waters described in the First Schedule to this order:
    (a) May, by bylaw, do anything which a Harbour Board may do, by bylaw, under section 232 of the Act;
    (b) May appoint harbourmasters and/or officers, and define or limit their powers or duties; and
    (c) Shall administer such regulations made pursuant to the Act as are applicable.

  2. The said rights, powers, and privileges may be at any time resumed by the Governor-General, without payment or any compensation whatever, on giving to the Council 6 calendar month's notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at, or posted to, the last-known address of the Council in New Zealand.
