Until such time as a revised valuation of the whole of
the said county shall come into effect the following provisions
shall apply:
(a) The council of the said county shall, under the pro-
visions of section 110 of the Counties Act 1956, make
and levy all rates separately in each of the former
counties provided that section 107 of the said Act
shall not apply to the said county.
(b) The provisions of Part IX of the Rating Act 1967 shall,
where applicable and with the necessary modifications, apply to the said county as if, for the purpose
of section 159 of the said Act, the said county were a
“special-purpose authority” within the provisions of
Part IX of that Act and, for the purpose of section
160 of that Act the districts formerly comprising the
counties of Halswell and Paparua were “constituent
districts” within the provisions of the said Part, and
all rates made and levied by the said county shall be
calculated on the adjusted valuation of the said
county. -
So far as they are applicable and with the necessary
modifications, the provisions of section 99A of the Land Transfer Act 1952 shall apply to the union hereby effected.
FIRST SCHEDULE
ALL that area in the former Halswell County, Canterbury
Land District, bounded by a line commencing at the intersection of the middle line of Dunbars Road and the middle
line of Halswell Road and proceeding southerly generally
along the middle of the latter road to the middle of Sparks
Road; thence easterly along the middle of that road to a point
in line with the eastern boundary of Lot 8, D.P. 17263; thence
southerly to and along that boundary and westerly along the
southern boundary of that lot and Lot 3, D.P. 17263 to a
point three chains east of the eastern side of Paterson Avenue;
then e southerly along a line parallel to and three chains east
of that roadside to a point in line with the middle of Glovers
Road; then e westerly generally to and along the middle of
that road, Halswell Road, and Candys Road to the middle of
Nottingham Stream; then e north-easterly along the middle
of that stream to a point in line with the south-western
boundary of Lot 17, D.P. 17266; then e north-westerly to and
along that boundary and its production to the middle of
Sabys Road; thence north-easterly along the middle of that
road and north-westerly along the middle of Quaifes Road
to a point eight chains west of the western side of Sabys
Road; thence easterly along a right line at right angles to
Quaifes Road a distance of three and a half chains; thence
south-easterly along a line parallel to and three chains north
of the northern side of Quaifes, north-easterly along a
line parallel to and three chains west of the western side of
Sabys Road and north-westerly along a line parallel to and
three chains south of the southern side of Halswell Junction
Road to the western boundary of R.S. 1033; thence northeasterly along a right line to the south-western corner of Lot
60, D.P. 20411 and continuing north-easterly along the northwestern boundaries of the land in that Deposited Plan and
D.P. 19690 to its most northerly corner; thence south-easterly
along the north-eastern boundary of the land in D.P. 19690
to a point in line with the north-western boundary of the
land in D.P. 21606; thence north-easterly to and along that
boundary and its production to the middle of Dunbars Road;
then e south-easterly along the middle of that road to the
point of commencement.
SECOND SCHEDULE
ALL that area in the former Halswell County, Canterbury
Land District bounded by a line commencing at the intersection of the middle line of Halswell Junction Road and the
middle line of Middle Lincoln Road and proceeding northeasterly along the middle of the latter road to a point in line
with the south-western boundary of R.S. 146; thence southeasterly to and along that boundary and its production to the
middle of the Heathcote River at the south-eastern corner of
D.P. 9987; thence south-westerly generally along the middle
of that river to a point in line with the middle of Templetons
Road; thence south-easterly to and along the middle of that
road and north-easterly along the middle of Halswell Road
to a point in line with the north-eastern side of Handersons
Road; thence south-easterly to and along that roadside to the
north-western boundary of Lot 1, D.P. 3217; thence northeasterly along that boundary and the north-western boundaries
of Lots 5 and 6, D.P. 3217 and south-easterly along the
north-eastern boundary of Lot 6, D.P. 3217 and its production
to the middle of Sparks Road; thence north-easterly
along the middle of that road to a point in line with the
eastern boundary of Lot 1, D.P. 20481; thence southerly
to and along that boundary and the eastern boundaries of
Lot 2, D.P. 20481, Pt. Lot 15 and Lot 22, D.P. 3217 to
the south-eastern corner of the last-mentioned lot, across
Cashmere Road along a right line to the north-eastern corner
of Lot 4, D.P. 23758 and along the eastern boundary of that
lot and its production to the middle of Cashmere Stream;
then e north-easterly generally along the middle of that stream
to the eastern side of Worsleys Road; thence southerly generally along that roadside, the north-eastern boundary of part
R.S. 37133, and again along the eastern side of Worsleys
Road to a point in line with the north-eastern boundary of
another part R.S. 37133; thence continuing south-easterly to
and along that boundary across Summit Road to and along
the north-eastern boundary of R. 3901 to the summit of the
Port Hills; thence southerly generally along that summit to
the middle of Bush Road; thence westerly generally along
the middle of that road, Summit Road, and Kennedys Bush
Road to a point in line with the north-western boundary of
R. 4069; thence south-westerly to and along that boundary
and south-westerly, north-westerly, and northerly along the
south-eastern, south-western, and western boundaries of R.S.
38702 to the middle of Early Valley Road; thence westerly
generally along the middle of that road and Old Tai Tapu
Road to a point in line with the southern boundary of Lot 1,
D.P. 16977; thence westerly along a right line aligned on
that boundary to the middle of Halswell River; thence northerly generally along the middle of that river and Knights
Stream to and along the north-western boundary of R.S.
952 and its production to the middle of Halswell Junction
Road; then e south-easterly along the middle of that road
to the point of commencement excluding therefrom the Halswell County Town Riding hereinbefore described.
THIRD SCHEDULE
ALL that area in the former Halswell County, Canterbury
Land District bounded by a line commencing at a point on
the summit of the Port Hills in the middle of Bush Road in
Block III, Halswell Survey District and proceeding southerly
generally along that summit to and along the eastern boundaries of Lots 1 and 2, D.P. 10264, in Blocks VII and XI,
Halswell Survey District, the eastern and south-eastern boundaries of R.S. 1863 and the south-eastern and south-western
boundaries of R.S. 1901 to a point in line with the middle
of Ahuriri Bush Road South; thence south-westerly generally
to and along the middle of that road and Park Hill Road to
a point in line with the former south-eastern boundary of R.S.
1069; thence south-westerly to and along that boundary
(through R.S. 37634) and its production to the middle of
Halswell River; thence northerly generally along the middle
of that river to a point in line with the southern boundary
of Lot 1, D.P. 16977, in Block II, Halswell Survey District;
then e easterly along a right line aligned on that boundary
to the middle of old Tai Tapu Road; thence north-easterly
generally along the middle of that road and Early Valley
Road to the western boundary of R.S. 38702; thence southerly,
south-easterly, and north-easterly along the western, southwestern, and south-eastern boundaries of that section and
north-easterly along the north-western boundary of R. 4069
and its production to the middle of Kennedys Bush Road;
then e easterly generally along the middle of that road,
Summit Road, and Bush Road to the point of commencement.
