  1. The first elections of members of the council and the Mayor of the said city shall be held on the day prescribed by law for the first triennial general election of members of local authorities to be held after the 1st day of April 1968.

  2. Until the members of the council of the said city elected at the said first triennial general election shall come into office the council of the said city shall consist of 15 members, exclusive of the Mayor of the said city, being the 12 members of the former council of the city of Napier, the Mayor of the former Taradale Borough Council and two of the members of the former Taradale Borough Council to be chosen by that council, and for the purpose of making that choice but for no other purpose, the members of the former Taradale Borough Council shall, if necessary, continue in office after the 31st day of March 1968.

  3. Until the Mayor to be elected at the said first triennial general election shall come into office the Mayor of the said city shall be the Mayor of the former City of Napier.

  4. For rating purposes only, the said city shall be divided into two divisions as follows:

(i) The Napier Division, comprising the area of the former City of Napier;

(ii) The Taradale Division, comprising the area of the former Borough of Taradale;

and such divisions shall exist for a period lasting until the total rate in the dollar levied in the Napier Division shall equal the total rate in the dollar levied in the Taradale Division or until the 31 March 1978, whichever shall be the earlier.

  1. Notwithstanding the provisions of the Municipal Corporations Act 1954 and subject to the provision of clause 8 hereof for the financial years in the period ending 31 March 1973, the total of all rates levied annually in the Taradale Division shall be 4 cents in the dollar of unimproved value and when the area of the said city is revalued and the new valuations are used for rating purposes as from 1 April 1973, the 4 cents in the dollar total rate levied in the said Taradale Division shall be reduced to such a total rate as will yield the same sum as would have been yielded on the basis of a total rate of 4 cents in the dollar on the valuation previously in force.

  2. For the purpose of levying the total rate in the said Taradale Division the council of the said city shall strike a consolidated rate on the said division consisting of:

(i) A consolidated special rate for the purposes of servicing loans secured over the Taradale Division only; and

(ii) A consolidated general rate of an amount in the dollar equal to the difference between the aforementioned consolidated special rate and a total rate of 4 cents in the dollar or such other total rate as may be levied on the above-mentioned new valuations.

  1. Until the expiration of the period prescribed in clause 8 hereof the provisions of sections 93, 93A, and 94 of the Municipal Corporations Act 1954 shall not apply to the said city.

  2. From the expiration of the period prescribed in clause 8 hereof the council of the said city shall consolidate all rates over the said city.

  3. The first Town Clerk of the said city shall be the Town Clerk of the former City of Napier.

  4. All existing staff of the councils of the former City of Napier and the former Borough of Taradale shall be taken over by the council of the said city under and subject to the provisions of the Local Authorities (Employment Protection) Act 1963. This provision shall be in extension of and subject to the provisions of that Act.

  5. Except as otherwise provided herein, or in the Local Government Commission Act 1967, the provisions of the Municipal Corporations Act 1954 shall with the necessary modifications and so far as they are applicable apply to the union hereby effected as if the former City of Napier and Borough of Taradale had been united under that Act and the District Land Registrar of the Hawke’s Bay Land Registration District is hereby directed to make such entries in his register, and to do all such other things as may be necessary to give effect to the provisions of this clause.

County of Halswell and County of Paparua United Under Name of Paparua County

ORDER IN COUNCIL

At the Government Buildings at Wellington this 25th day of March 1968

Present:

THE RIGHT HON. KEITH HOLYOAKE, C.H., PRESIDING IN COUNCIL

PURSUANT to the Local Government Commission Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order:

O R D E R

  1. This order shall come into force on 1 April 1968.

  2. The County of Halswell and the County of Paparua are hereby united and the councils of the said counties are hereby dissolved.

  3. The united county shall be called the County of Paparua (hereinafter called the “said county”).

  4. For representation purposes the said county shall be divided into 12 ridings as follows:

(i) The Sockburn Riding, comprising the Sockburn Riding of the former County of Paparua.

(ii) The Hornby Riding, comprising the Hornby Riding of the former County of Paparua.

(iii) The Islington Riding, comprising the Islington Riding of the former County of Paparua.

(iv) The Templeton Riding, comprising the Templeton Riding of the former County of Paparua.

(v) The Yaldhurst Riding, comprising the Yaldhurst Riding of the former County of Paparua.

(vi) The West Melton Riding, comprising the West Melton Riding of the former County of Paparua.

(vii) The Prebbleton Riding, comprising the Prebbleton Riding of the former County of Paparua.

(viii) The Broadfield Riding, comprising the Broadfield Riding of the former County of Paparua.

(ix) The Ladbrooks Riding, comprising the Ladbrooks Riding of the former County of Paparua.

(x) The Halswell County Town Riding, comprising that area of the former County of Halswell described in the First Schedule hereto.

(xi) The Halswell Rural Riding, comprising the area of the former County of Halswell described in the Second Schedule hereto.

(xii) The Tai Tapu Riding, comprising that area of the former County of Halswell described in the Third Schedule hereto.

  1. The council of the said county shall consist of 15 members as follows:

For the Sockburn Riding ..... 2 members

For the Hornby Riding ..... 3 members

For the Islington Riding ..... 1 member

For the Templeton Riding ..... 1 member

For the Yaldhurst Riding ..... 1 member

For the West Melton Riding ..... 1 member

For the Prebbleton Riding ..... 1 member

For the Broadfield Riding ..... 1 member

For the Ladbrooks Riding ..... 1 member

For the Tai Tapu Riding ..... 1 member

For the Halswell County Town Riding ..... 1 member

For the Halswell Rural Riding ..... 1 member

  1. The first election of members of the council of the said county shall be held on the date prescribed by law for the next triennial general elections of members of county councils.

  2. Until the members of the council of the said county elected at the said first election shall come into office, the said council shall consist of:

(i) The 12 members of the former Paparua County Council, and

(ii) Three of the members of the former Halswell County Council to be chosen by that Council from among its members and for the purpose of making that choice, but for no other purpose, the Council of that County shall, where necessary, continue in office after the constitution of the said county.

  1. The Halswell County Town Riding of the said county shall be a county town having the name of Halswell County Town and the provisions of the Counties Act 1956 shall apply in all respects as if the said county town had been constituted under section 417 of that Act.

  2. All bylaws in force in the former County of Paparua shall become bylaws of the said county and except as hereinafter provided, all bylaws in force in the former County of Halswell shall be deemed to have been revoked on the constitution of the said county, provided however that the High Pressure Water Supply Bylaws of each of the former counties shall become bylaws of the said county and shall apply in the respective High Pressure Water Districts of the respective former counties.

  3. Except as otherwise provided herein or in the Local Government Commission Act 1967 the provisions of section 10 of the Counties Act 1956 shall apply to the union of counties hereby effected as if the former counties of Halswell and Paparua had been united under that Act.

  4. All existing staff of the councils of each of the said former counties shall be taken over by the council of the said county under and subject to the provisions of the Local Authorities (Employment Protection) Act 1963. This provision shall be in extension of and subject to the provisions of the said Act.

  5. The first County Clerk of the said county shall be the County Clerk of the former County of Paparua.

  6. In accordance with the provisions of subsection (2) of section 28B of the Town and Country Planning Act 1953 it is hereby directed that the said county shall not proceed to prepare a new district scheme for the whole of its district but that it shall continue to administer the proposed district scheme of the former County of Paparua and the draft district scheme of the former County of Halswell.
