The Indecent Publications Act 1963

IN the matter of the Indecent Publications Act 1963 and in
the matter of an application to the Tribunal for a decision
regarding the book Last Exit to Brooklyn by Hubert Selby
junior, published by Calder and Boyars, London.

DECISION OF THE TRIBUNAL

THE Tribunal has considered the application of the Secretary
for Justice for a decision in respect of the above-named
book—whether it is indecent or not or for some other decision
as to its classification. The Justice Department was represented
and in a letter made submissions drawing the attention of
the Tribunal to paragraph (a) of section 11 (1) of the
Indecent Publications Act 1963, and claiming that the dominant
effect of the book as a whole “outweighed its acknowledged
honesty of purpose”. The publishers made no submissions
as their agents hold no stocks in New Zealand at the present
time and the book would seem to have “run its course” here.
The book submitted is in a hard back edition selling in
England at 30s.

Last Exit to Brooklyn describes life in a district of New
York where an underprivileged and frustrated population is
reduced to the extremes of lawlessness and vice. The dominant
effect of the book may well be one of revulsion which could
nevertheless evoke salutary compassion and concern; it has
the stamp of honesty and anger; such a document should not
be ignored.

Its proper use however is not as casual reading for the general
public because it deals almost exclusively and in sickening
detail with the grossest forms of evil. We therefore classify
this book as indecent except in the hands of adults engaged
in work or research in sociological and related fields.

Joseph Dow, M.D., published by Monogram Publications Inc.,
Inglewood, California, U.S.A., is indecent or not or for a
decision as to its classification.

Tariff Notice No. 1967/90—Revocation of Approval of
Textile Fabrics Under Part II, Reference 11.0 of the Tariff

NOTICE is hereby given that the approval in respect of all
woven textile fabrics containing man-made discontinuous
fibres and weighing more than 5½ oz per sq. yd., will be
revoked with effect from 31 December 1967.

This revocation covers all approvals of individual textile
fabrics and also the following decisions published under
Section XI and heading 58.04:

Section XI Tickings, mattress.
Heading 58.04 Woven pile fabrics being imitation fur
fabrics, but not including fabrics assem-
bled by sewing, gumming, or similar
operation.

(a) The range of equivalent goods manufactured locally;
(b) The proportion of New Zealand and imported materials used in manufacture;
(c) Present and potential output; and
(d) Details of factory cost in terms of materials, labour, overhead, etc.
