Boundaries of Counties of Whakatane and Wairoa Altered

ORDER IN COUNCIL

At the Government House at Wellington this 19th day of October 1967

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Local Government Commission Act 1961, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

O R D E R

  1. This order shall take effect on 1 November 1967.

  2. The Second and Third Schedules of the Order in Council dated 17 November 1964*, are hereby revoked.

  3. The area described in the First Schedule hereto is hereby excluded from the County of Whakatane and included in the County of Wairoa.

  4. The area described in the Second Schedule hereto is hereby excluded from the County of Wairoa and included in the County of Whakatane.

  5. The alterations of the boundaries of the said counties hereinbefore made shall be deemed to have been effected under the Counties Act 1956.

FIRST SCHEDULE

ALL that area in the South Auckland and Gisborne Land Districts, Whakatane County, containing approximately 97,600 acres, bounded by a line commencing at Trig. Station 2126, Maungapohatu in Block XII, Ruatahuna Survey District, and proceeding south-easterly along the north-eastern boundary of Whakatane County as described in New Zealand Gazette, 1962/867, page 1426, to its easternmost corner in Block II, Tuahu Survey District; thence south-westerly generally along the south-eastern boundary of the Whakatane County to its intersection with the south-eastern watershed of the Rangitaiki and Whakatane Rivers in Block XIII, Tuwatawata Survey District; thence north-easterly generally along that watershed to the point of commencement.

SECOND SCHEDULE

ALL that area in the South Auckland Land District, Wairoa County, containing 563 acres, bounded by a line commencing at a point being the intersection of the north-western boundary of the Wairoa County with the south-eastern watershed of the Rangitaiki and Whakatane Rivers in Block XIII, Tuwatawata Survey District; and proceeding south-westerly along the north-western boundary of the Wairoa County as described in New Zealand Gazette, 1955, page 363, to its westernmost corner; thence south-easterly along the south-western boundary of that county to its intersection with the aforementioned watershed in Block XIII, Tuwatawata Survey District; thence northerly generally along that watershed to the point of commencement.

Consenting to Stopping Road in Block IV, Maungatautari Survey District, Matamata County

At the Government House at Wellington this 27th day of September 1967

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 149 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the Matamata County Council stopping the portions of road described in the Schedule hereto.

SOUTH AUCKLAND LAND DISTRICT

ALL those portions of road situated in Block IV, Maungatautari Survey District, described as follows:

As the same are more particularly delineated on the plan marked M.O.W. 21414 (S.O. 41580) deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

Declaring an Access Way to be Vested in the Corporation of the City of Porirua and to be Under the Control and Management of the Porirua City Council

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 11 of the Housing Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the access way described in the Schedule hereto shall, on and after the date of this Order in Council, vest in the Mayor, Councillors, and Citizens of the City of Porirua, and be under the control and management of the Porirua City Council.

WELLINGTON LAND DISTRICT

ALL that piece of land containing 3.65 perches, situated in the City of Porirua, Wellington R.D., and being Lot 5, D.P. 19349. Part certificate of title, Volume 856, folio 52, Wellington Land Registry.

The Coromandel Mining Order 1967

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 34 of the Statutes Amendment Act 1940, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

O R D E R

  1. (1) This order may be cited as the Coromandel Mining Order 1967.

(2) This order shall come into force on the day after the date of its publication in the Gazette.

  1. It is hereby declared that, from and after the commencement of this order, no mining privilege affecting the lands described in the Schedule to this order shall be granted without the written consent of the Minister of Mines.

  2. Subject to the provisions of section 34 of the Statutes Amendment Act 1940, no mining privilege affecting the lands described in the Schedule to this order, whether granted before or after the commencement of this order, shall be transferred, leased, mortgaged, pledged, or otherwise disposed of or dealt with, whether by the holder thereof or by any executor or administrator, without the previous written consent of the Minister of Mines; nor shall any such mining privilege be liable to forfeiture for any cause whatsoever, and no certificate of abandonment in respect of any such mining privilege shall be given without the like consent.
