Declaring Land Taken, Together With and Subject to Certain Rights and Encumbrances as to Part for Better Utilisation in the City of Wellington

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, sufficient agreements to that effect having been entered into, the land described in the First Schedule hereto is hereby taken for better utilisation and the land described in the Second Schedule hereto is hereby taken, subject to Proclamation No. 666674, Wellington Land Registry, defining the middle line of a portion of the Ngauranga - Basin Reserve Motorway for better utilisation, and the land described in the Third Schedule hereto, is hereby taken, subject to K. 43156 condition of consent of the Wellington City Council to the granting and reserving of rights of way over the land in certificate of title, Volume 401, folio 25, appurtenant to the land contained in certificate of title, Volume 401, folio 24, and subject to the right of way granted by transfer No. 425005 and subject to Proclamation No. 666674 aforesaid, for better utilisation, and the land described in the Fourth Schedule hereto is hereby taken, together with the rights of way created by transfer No. 418350, and subject to K. 43156 condition of consent of the Wellington City Council, to the granting and reserving of rights of way over the land in certificate of title, Volume 401, folio 25, appurtenant to the land contained in certificate of title, Volume 401, folio 23, and subject to Proclamation No. 666674 aforesaid, for better utilisation and the land described in the Fifth Schedule hereto is hereby taken, subject to Order in Council No. 366, exempting Hill Street from the provisions of section 117 of the Public Works Act 1905, and subject to Proclamation No. 666674 aforesaid for better utilisation from and after the 25th day of September 1967.

Declaring Land and Easements Over Land Taken for an Electric Power Sub-Station in the City of Wellington

———

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the land first described in the Schedule hereto is hereby taken for an electric power sub-station and shall vest in the Mayor, Councillors, and Citizens of the City of Wellington from and after the 25th day of September 1967; and also hereby declares that easements in connection therewith, and forever appurtenant thereto, are hereby taken over the land secondly and thirdly described in the said Schedule hereto, vesting in the Mayor, Councillors, and Citizens of the City of Wellington, the full and free rights, liberties, licences, and privileges in perpetuity, that is to say:

(a) The right to transmit electrical energy backwards and forwards, under and along the land secondly described in the said Schedule hereto;

(b) The right of ingress, egress, and regress on foot, with or without vehicles of all descriptions, either loaded or unloaded by night as well as by day, over and along the lands secondly and thirdly described in the said Schedule hereto.

(c) The right to enter upon all or any of the said lands secondly and thirdly described in the said Schedule hereto, at all reasonable times by its servants, agents, and workmen, with all necessary tools, implements, plant, machinery, and vehicles for the purpose of laying, constructing, repairing, renewing, and maintaining at such depths as shall be necessary, all cables and fittings as shall be required for the unimpeded transmission of electrical energy as aforesaid.

(d) The right to dig up and break the surface of the said lands secondly and thirdly described in the said Schedule hereto, or any parts thereof, and generally to do and perform all acts and things as may be necessary or proper, including reinstatement of the said lands for any of the purposes hereinbefore mentioned; provided however that the registered owner of the said lands secondly and thirdly described in the said Schedule hereto, shall be given reasonable notice before any work hereunder is commenced, and that when any such work is being carried out, there shall be caused as little interference as possible to the said registered owner’s access to Daniell Street, from and after the 25th day of September 1967.
