THE CHARITABLE TRUSTS ACT 1957
NOTICE OF APPLICATION FOR APPROVAL OF SCHEME
By the will of Charles Henry Martin, late of “Mount Hamburgh” Suburban North, Nelson, who died in 1917, he provided for the income from his land known as “The Quarry” to be used to provide annual prizes for the public schools of Hillside, Clifton Terrace, and Happy Valley, in the Provincial District of Nelson, and for one pupil at the Nelson School of Music. A level piece of ground was to be available for a picnic or camping ground or as a site for a public hall. The income from the rest of his land was to be paid to the Nelson Hospital for the comfort of patients. In 1962 the Public Trustee was appointed as trustee of the estate which consists of about seven acres of vacant land at Wakapuaka, and a small sum of cash. The Public Trustee, after consulting interested bodies, has filed in the Office of the Supreme Court, at Nelson, an application for approval of a scheme for disposition of the estate assets under Part III of the Act. The scheme proposes that the land be sold and the net proceeds be divided into nine equal parts of which:
(a) Six would be paid to the Nelson Hospital Board for the purchase of certain amenities for patients at the Nelson Public Hospital.
(b) Two would be paid to the Nelson Education Board for the purchase of library books and other educational equipment for the Clifton Terrace and Hira Schools.
(c) One would be paid to the Nelson School of Music for the replacement of instruments and music.
Copies of the scheme and the report of the Attorney-General thereon may be inspected, free of charge, at the office of the Registrar of the Supreme Court, Nelson, and at the Public Trust Offices at Nelson and Wellington. It is proposed that the application be heard at Wellington, on 4 September 1967. Any person desiring to oppose the scheme is hereby required to give written notice of his intention to do so, to the Registrar of the Supreme Court, at Nelson, and to the Public Trustee at Nelson or Wellington, and to the Attorney-General not less than seven clear days before that date.
R. E. C. BEATSON,
Solicitor to the Public Trust Office, Wellington.
