National Roads Board—Notice Declaring State Highway to be a Limited Access Road

It is hereby notified that the National Roads Board by resolution dated 21 June 1967, and pursuant to section 4 of the Public Works Amendment Act 1963, declares that part of No. 29 State Highway (Tauranga-Piarere) from Barke's Corner at the junction of S.H. 29 with Pyes Pa Road and Cameron Road, to a point 1 mile 28 chains measured generally south-westerly along S.H. 29 from its junction with Cambridge Road at Tauriko, as more particularly shown on sheets 1, 2, 3, and 4, of M.O.W. 13422, and the accompanying schedule held in the office of the Resident Engineer, Ministry of Works, Tauranga, and there available for public inspection, to be a limited access road.

It is hereby notified that the National Roads Board by resolution dated 21 June 1967, and pursuant to section 4 of the Public Works Amendment Act 1963, declares that part of No. 1 State Highway (Awanui-Bluff) from its junction with the Pukekohe - Bombay Road (Collision Crossroads Corner), generally southwards to a point opposite the north-eastern corner of Lot 2, D.P. 30549, a distance of 4½ miles, as more particularly shown on sheet 1 of M.O.W. 13363, and the accompanying schedule held in the office of the Resident Engineer, Southern Residency, Ministry of Works, Auckland, and there available for public inspection, to be a limited access road.

Price Order No. 2056 (Woolpacks)

PURSUANT to the Control of Prices Act 1947, I, Geoffrey Harold Datson, pursuant to a delegation from the Secretary of Industries and Commerce acting under a delegation from the Price Tribunal, hereby make the following price order:

PRELIMINARY

  1. This order may be cited as Price Order No. 2056 and shall come into force on the 21st day of July 1967.

  2. (1) Price Orders Nos. 2015* and 2049 are hereby revoked.

(2) The revocation of the said price orders shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this order.

  1. In this price order the terms “existing currency”, and “transitional period” shall have the same meaning as in the Decimal Currency Act 1964.

APPLICATION OF THIS ORDER

  1. This order applies only with respect to sales by way of retail of 42 in. woolpacks.

FIXING MAXIMUM RETAIL PRICE OF WOOLPACKS TO WHICH THIS ORDER APPLIES

  1. (1) Subject to the following provisions of this clause, the maximum price that may be charged or received by any retailer for any woolpacks to which this order applies shall be:

(a) For woolpacks sold by a retailer carrying on business at one of the ports of Auckland, Wellington, Lyttelton, Dunedin, Timaru, Bluff or Napier: $1.48 each; provided that where a trader because of difficulties relating to machine conversion continues to deal exclusively or principally in existing currency during the transitional period the maximum price which may be charged or received shall be 14s. 9d. each.

(b) For woolpacks sold by a retailer carrying on business elsewhere than at one of the ports mentioned in paragraph (a) hereof: $1.48 or 14s. 9d. each, whichever is appropriate in accordance with the provisions of paragraph (a) hereof, increased by the appropriate proportion of the freight charges incurred by the retailer in obtaining delivery from such one of the said ports as is most convenient of access to his store:

Provided that, where any woolpacks to which this paragraph applies are obtained by the retailer elsewhere than from such one of the said ports as is most convenient of access to his store, the increase authorised by this paragraph shall not exceed the appropriate proportion of the freight charges that would have been incurred by the retailer if the woolpacks had been obtained from that port and if delivery had been effected at current freight rates.

(2) The maximum prices fixed by the last preceding sub-clause are fixed as for delivery f.o.r. or f.o.b. as the case may require.

(3) Where any woolpacks are delivered by a retailer otherwise than f.o.r. or f.o.b., the price that may be charged by the retailer shall be the appropriate price in terms of the foregoing provisions of this clause increased by the amount of the freight charges incurred by him in effecting delivery and then reduced by the amount of those charges that would have been incurred by him if he had delivered the woolpacks f.o.r. or f.o.b. as aforesaid.

(4) Any freight charges imposed by a retailer pursuant to the foregoing provisions of this clause shall be shown separately on the appropriate invoice.

  1. Notwithstanding anything in the foregoing provisions of this order, and subject to such conditions, if any, as it thinks fit, the Tribunal, on application by any retailer, may authorise special maximum retail prices in respect of any woolpacks, to which this order applies where special circumstances exist, or for any reason extraordinary charges (freight or otherwise) are incurred by the retailer. Any authority given by the Tribunal under this clause may apply with respect to a specified lot or consignment of woolpacks or may relate generally to all woolpacks to which this order applies sold by the retailer while the approval remains in force.
