Land and an Easement Over Land Taken for a Parking Place in the City of Manukau

BERNARD FERGUSSON, Governor-General

A PROCLAMATION

PURSUANT to the Public Works Act 1928, I, Brigadier Sir Bernard Edward Fergusson, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the First Schedule hereto is hereby taken for a parking place and shall vest in the corporation of the Mayor, Councillors, and Citizens of the City of Manukau and that an easement (right of way) is hereby taken for a parking place over the land described in the Second Schedule hereto, vesting in the corporation of the Mayor, Councillors, and Citizens of the City of Manukau, full and free right, liberty, licence, and authority in perpetuity for the said corporation, its servants, agents, workmen, licensees, and invitees (in common with all other persons lawfully using the same), from time to time and at all times by day and by night to go, pass, and repass, with or without horses and domestic animals of any kind, and with or without carriages, vehicles, motor vehicles, machinery, and implements of any kind, over and along the land described in the said Second Schedule, and to maintain, repair, and keep open the said right of way; and I also declare that the aforesaid easement shall be held appurtenant to the land described in the Third Schedule hereto, and that this Proclamation shall take effect from and after the 26th day of June 1967.


FIRST SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL those pieces of land situated in Block XIV, Otahuhu Survey District, City of Manukau, North Auckland R.D., described as follows:

A. R. P. Being
0 0 1.7 Part Lot 1, D.P. 39659; coloured sepia on plan.
0 0 1.7 Part Lot 2, D.P. 39659; coloured blue on plan.


SECOND SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL those pieces of land situated in Block XIV, Otahuhu Survey District, City of Manukau, North Auckland R.D., described as follows:

A. R. P. Being
0 0 3.7 Part Lot 2, D.P. 35850; coloured yellow, edged yellow on plan.
0 0 1.5 Part Lot 2, D.P. 35850; coloured yellow on plan.

As the same are more particularly delineated on the plan marked M.O.W. 21195 (S.O. 45256) deposited in the office of the Minister of Works at Wellington, and thereon coloured as above mentioned.


THIRD SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL those pieces of land situated in Block XIV, Otahuhu Survey District, City of Manukau, North Auckland R.D., described as follows:

0 1 11 Part Lot 1, D.P. 35850. All certificate of title, Volume 1806, folio 57.
0 1 8.4 Part Lot 2, D.P. 41168. All certificate of title, Volume 1674, folio 46.
0 0 7.7 Part Lot 2, D.P. 41168. All certificate of title, Volume 1374, folio 66.

All North Auckland Land Registry.

PURSUANT to the Public Works Act 1928, I, Brigadier Sir Bernard Edward Fergusson, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the Schedule hereto is hereby taken for the development of water power (Wellsford Substation).


SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL those pieces of land situated in Block XII, Otamatea Survey District, North Auckland R.D., described as follows:

A. R. P. Being
8 2 5.7 Part Lot 2, D.P. 41865.
0 0 33.3 Part Allotment 285, Oruawharo Parish.
0 0 16.1 Part Allotment 288, Oruawharo Parish.

As the same are more particularly delineated on the plan marked M.O.W. 21240 (S.O. 45377) deposited in the office of the Minister of Works at Wellington, and thereon coloured yellow.
