THE CHARITABLE TRUSTS ACT 1957

NOTICE OF APPLICATION FOR APPROVAL OF SCHEME

In the matter of the Alexander Turnbull Library Endowment
Trust Board, notice is hereby given that an application has
been made to the Supreme Court of New Zealand, under
Part III of the above-mentioned Act, by the above-named
Board for its approval of a scheme for the extension or
variation of the powers of the Board and the mode of
administering the trusts of Deed of Declaration of Trust, dated
the 7th day of November 1934. The said deed provides that
the trustees are empowered to apply the income of the trust
fund in or towards the purchase of material for the Alexander
Turnbull Library, at Wellington, and in the binding, rebinding,
and restoration of such purchases. It has been found in
practice that certain other powers are desirable to enable the
Board effectively to carry out the intention of the Trust under
present day conditions. Under the scheme proposed, which has
been filed in the Court, and a copy of which may be inspected
at the office of the undersigned solicitors to the Board, the
Board will be empowered to expend capital or income of the
fund (subject to retention at all times of not less than £5,000
of capital), on the existing objects and in the following
additional ways:

  1. In the microfilming or other forms of copying or repro-
ducing of material for or in the library.

  2. In making or having made copies or reproductions of
any material owned by the library or the Board.

  3. In having edited and published material from the holdings
of the library or the Board.

The Board will also be empowered to sell, exchange, donate,
or otherwise dispose of such reproductions or publications,
or any surplus material in the hands of the Board.

The scheme also provides for removal of the special
qualifications of the trustees of the deed and will give to
the Board the usual power of appointment of new trustees
along the lines provided in the Trustee Act 1956.

The said application is set down for hearing before the
Supreme Court at Wellington, on Wednesday, the 28th day of
June 1967, at 10 a.m., and any person desiring to oppose the
said scheme is required to give written notice of his intention
to do so to the Registrar of the Supreme Court at Wellington,
and to the Board, and to the Attorney-General, no less
than seven (7) clear days before that date.

Dated this 18th day of May 1967.

HADFIELD, PEACOCK, TRIPE, AND FEIST,
Solicitors to the Board.

General Buildings, Waring Taylor Street, Wellington.
