Departure from Operative District Scheme
PUBLIC notice is hereby given that, pursuant to the provisions of the Town and Country Planning Act 1953 and its amendments, and of the regulations made thereunder, the Town and Country Planning Appeal Board, by order No. 244/66, dated the 14th day of November 1966, gave consent to a specified departure from the provisions of the City of Wanganui district scheme by permitting the Wanganui City Council to permit and allow Miss Doris Scott and Miss Elizabeth McKenzie and successors in title to use that piece of land containing 15·6 perches, being part of Lot 30, Deposited Plan 1403, and situated on the corner of Tawa Street and Kings Avenue in the City of Wanganui, for residential purposes, notwithstanding that the area of land is below the minimum permitted by the code of ordinances of the City of Wanganui district scheme applicable for such purposes, the following conditions to apply:
- The shop at present existing on the land to be demolished and removed from the site before such use be commenced.
- That all relevant provisions of the code of ordinances, other than that to which dispensation is herein granted, apply to any development on the site; including, in particular, the bulk and location provisions relative.

Departure From Operative District Scheme
PUBLIC notice is hereby given that, pursuant to the provisions of the Town and Country Planning Act 1953 and its amendments, and of the regulations made thereunder, the Town and Country Planning Appeal Board, by order No. 196/66, dated the 14th day of November 1966, gave consent to a specified departure from the provisions of the City of Wanganui district scheme by permitting the applicants, Blake Engineering Co. Ltd., to use that piece of land containing 39·33 perches, more or less, being part of Sections 34 and 37 of the Town of Wanganui, and being also part of the land in Deposited Plans Nos. 5593 and 12408, situated at No. 13 Saint Hill Street, in the City of Wanganui, for the purpose of conducting thereon the business of manufacture of dies by the accepted process of die casting, notwithstanding that the land is at present zoned commercial C and shall remain so zoned, the following conditions to apply:
- That machinery shall not be placed or operated so as to cause vibration in the wall adjacent to the Criterion Hotel premises, should such vibration cause annoyance to the residents and guests in the Hotel. In the event of machinery being so placed or operated and causing such annoyance, the machinery shall forthwith be shifted.
- In the event of machinery being placed in any part of the building adjacent to the Hotel, the owner of the premises the subject of this application shall use his best endeavours to reduce any noise factor which may cause nuisance or annoyance to the residents and guests in the Hotel; and in the event of such nuisance or annoyance being caused and not being effectively reduced, then leave is reserved to apply further to the Town and Country Planning Appeal Board.
- The owner of the said premises shall effectively dispose of fumes from any of the operations carried on in the said premises, so that such fumes shall not cause nuisance or annoyance to the residents and guests in the Hotel premises; and the owner shall also comply with all directions from the Labour Department as to the expulsion of such fumes.
- Leave is also reserved to apply to the Board in the event of any dispute under clauses 1 and 3 hereof.

MOUNT WELLINGTON BOROUGH COUNCIL

Changes of Mount Wellington District Schemes Approved
PURSUANT to the Town and Country Planning Regulations 1960, public notice is hereby given that the changes of the district schemes under the Town and Country Planning Act 1953 for the Borough of Mount Wellington relating to the areas and matters set forth in the Schedule to this notice were approved by the Mount Wellington Borough Council by resolution passed at its meeting held on the 9th day of
1985
November 1966, after all objections, appeals, and arbitrations relating to the changes of the schemes had been disposed of, and the changes to the schemes had been amended to give effect to all objections and appeals allowed.
The Council has also resolved that the changes of the schemes shall come into operation on the 30th day of November 1966.
A copy of the changes of the schemes and the schemes themselves as amended by the changes has been deposited in the Council's office and may be inspected, without fee, by any person who so requires at any time when the office is open to the public.
