Declaring That the Course of the Tutaenui Stream in Block XI, Rangitoto Survey District, Rangitikei County, Shall be Altered or Diverted

A PROCLAMATION

PURSUANT to section 207 of the Public Works Act 1928, I, Brigadier Sir Bernard Edward Fergusson, the Governor-General of New Zealand, hereby proclaim and declare that the course of the Tutaenui Stream shall be altered or diverted within the area of land described in the Schedule hereto.

SCHEDULE

WELLINGTON LAND DISTRICT

ALL that piece of land containing 3 roods 9·7 perches situated in Block XI, Rangitoto Survey District, Wellington R.D., being part Lot 1, D.P. 11827, being part Blocks III and IV, Rangitikei District; as the same is more particularly delineated on the plan marked M.O.W. 20680 (S.O. 25989) deposited in the office of the Minister of Works at Wellington, and thereon coloured orange.

Given under the hand of His Excellency the Governor-General, and issued under the Seal of New Zealand, this 8th day of September 1966.

PURSUANT to the Local Authorities Loans Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto by way of loan of the whole or any part of the respective amounts specified in that Schedule.

The Wairere Electric Power Board Water Power and Electric Lines Licence 1966

ORDER IN COUNCIL

At the Government House at Wellington this 2nd day of November 1966

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act 1928 and the Electric Power Boards Act 1925, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order may be cited as the Wairere Electric Power Board Water Power and Electric Lines Licence 1966.

  2. Subject to the conditions hereinafter set forth, the Wairere Electric Power Board (hereinafter referred to as the licensee) is hereby granted a licence to obstruct, impound, or divert the waters of the Mokau and Mokauiti Rivers situated in the Waitomo County, to raise or lower the levels thereof, and to take and use therefrom, for the purpose hereinafter set forth, streams of water not exceeding respectively 100 and 200 cu. ft. per second, and also to lay, construct, put up, place, and use the electric lines and to construct the electric works described in the First Schedule hereto.

  3. The water shall be taken from:

(a) The Mokau River at a point in Section 1, Block VI, Totoro Survey District.

(b) The Mokauiti River at a point in Section 3, Block IX, Totoro Survey District.

All as indicated on the plan marked N.Z.E.D. 588 deposited in the office of the New Zealand Electricity Department at Wellington. The water shall be used solely for the purpose of generating electricity.

  1. The conditions directed to be implied in all licences by the Water Power Regulations 1934, the Electrical Supply Regulations 1935, and the Electrical Wiring Regulations 1961 shall be incorporated herein and shall form part of this licence, except in so far as they may be inconsistent with the provisions of this licence.

  2. This licence is issued under the Water Power Regulations 1934, and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1961, the Radio Interference Regulations 1958, and to all regulations made in amendment thereof or in substitution therefor, except in so far as they may be inconsistent with the provisions of this licence.

  3. The licensee is hereby authorised, subject to the conditions hereof, to construct, maintain, and use the works described in the Second Schedule hereto, the positions of the said works being indicated on the said plan N.Z.E.D. 588.

  4. The systems of supply shall be as described in paragraphs (a), (c), (d), (e), (f), and (j) of regulation 21-01 of the Electrical Supply Regulations 1935. The system of supply authorised under paragraph (j) shall be a single-conductor earth-return system and the use thereof shall be subject to such terms and conditions as are from time to time laid down by the General Manager of the New Zealand Electricity Department.

  5. Nothing in this licence shall of itself be deemed to create any right to water.

  6. This licence shall, unless sooner lawfully determined, continue in force until the 31st day of March 1987.

  7. The Orders in Council specified in the Third Schedule hereto, authorising the licensee to erect and use electric lines and to construct electric works, and to use water for the purpose of generating electricity, are hereby revoked.

FIRST SCHEDULE

ELECTRIC LINES AND ELECTRIC WORKS

ELECTRIC lines and electric works which may from time to time be required for the distribution and supply of electrical energy:

(1) Commencing at the New Zealand Electricity Department’s Ongarue substation and proceeding thence in a north-westerly direction to the southern boundary of the Wairere Electric Power District, the said lines being shown by means of a red line on the plan marked S.H.D. 303 deposited as aforesaid.

(2) Commencing from the lines described in the last-preceding paragraph at a point in part 61c, Section 3, Block VIII, Aria Survey District, and proceeding thence in a north-easterly direction to the southern boundary of the Wairere Electric Power District, the said lines being shown by means of a blue line on the said plan S.H.D. 303.

(3) Within the Wairere Electric Power District as defined in the Third Schedule to the Proclamation dated the 15th day of September 1952, and published in the Gazette on the 18th day of the same month, at page 1513.

SECOND SCHEDULE

GENERAL DESCRIPTION OF GENERATING WORKS

  1. Mokau River:

(a) Headworks consisting of a dam, spillway, and intake on the Mokau River approximately 5 miles downstream from the township of Piopio.

(b) Conduit: concrete-steel conduits with surge chambers and penstocks leading from the dam to the powerhouse.

(c) Powerhouse with water turbines, generators, and all necessary equipment for generating electricity, having a maximum capacity of 1,400 kilowatts.

(d) Tailrace from the powerhouse aforesaid to the Mokau River.
