Present:

THE RIGHT HON. KEITH HOLYOAKE, C.H., PRESIDING IN COUNCIL

PURSUANT to the Public Works Act 1928 and the Electric Power Boards Act 1925, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.


ORDER

  1. This order may be cited as the Egmont Electric Power Board Water Power and Electric Lines Licence 1966.

  2. Subject to the conditions hereinafter set forth, the Egmont Electric Power Board (hereinafter referred to as the licensee) is hereby granted a licence to obstruct, impound, or divert the waters of the Waiaua River, to raise or lower the level thereof, and to take and use therefrom, for the purpose hereinafter set forth, a stream of water not exceeding 55 cu. ft. per second and also to lay, construct, put up, place, and use electric lines and to construct electric works which may from time to time be required for the distribution and supply of electricity within the area described in the First Schedule hereto.

  3. The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electric Supply Regulations 1935 shall be incorporated herein and shall form part of this licence, except in so far as they may be inconsistent with the provisions of this licence.

  4. This licence is issued under the Water Power Regulations 1934 and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1961, the Radio Interference Regulations 1958, and to all regulations made in amendment thereof or in substitution therefor, except in so far as they may be inconsistent with the provisions of this licence.

  5. The water shall be taken from the Waiaua River at a point indicated on the plan marked N.Z.E.D. 700 deposited in the office of the New Zealand Electricity Department at Wellington. The water shall be used solely for the purpose of generating electricity.

  6. The licensee is hereby authorised, subject to the conditions hereof, to construct, maintain, and use the works described in the Second Schedule hereto, the position of the said works being indicated on the said plan N.Z.E.D. 700.

  7. The systems of supply shall be as described in paragraphs (a), (b), (c), (d), (e), (f), and (h) of regulation 21–01 of the Electrical Supply Regulations 1935.

  8. Nothing in this licence shall of itself be deemed to confer upon the licensee any right to water.

  9. This licence shall, unless sooner lawfully determined, continue in force until the 31st day of March 1986.

  10. The Orders in Council specified in the Third Schedule hereto are hereby revoked.


FIRST SCHEDULE

AREA OF SUPPLY

THE Egmont Electric Power District as defined in the Fourth Schedule to the Proclamation, dated the 8th day of November 1965, and published in the Gazette on the 18th day of the same month, at page 2041.


SECOND SCHEDULE

GENERAL DESCRIPTION OF GENERATING WORKS

(a) Headworks consisting of dams and the necessary intakes on the Waiaua River.

(b) Pipeline leading to the power house hereinafter referred to.

(c) Power house with a water turbine and all necessary equipment for generating electricity having a maximum capacity of 315 kilowatts.

(d) Tail race leading from the said power house to the Waiaua River.

  2. Subject to the conditions hereinafter set forth, the Wanganui-Rangitikei Electric Power Board (hereinafter referred to as the licensee) is hereby authorised to lay, construct, put up, place, and use the electric lines described in the First Schedule hereto, and to construct electric works which may from time to time be required for the distribution and supply of electricity within the area of supply described in the First Schedule hereto.

  3. The conditions directed to be implied in all licences by the Electrical Supply Regulations 1935 and the Electrical Wiring Regulations 1961 shall be incorporated herein and shall form part of this licence, except in so far as they may be inconsistent with the provisions of this licence.

  4. The licence hereby conferred is subject to compliance by the licensee with the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1961, the Radio Interference Regulations 1958, and with all regulations made in amendment thereof or in substitution therefor, except in so far as they may be inconsistent with the provisions of this licence.

  5. The systems of supply shall be as described in paragraphs (a), (b), (c), (d), (e), (f), and (h) of regulation 21–01 of the Electrical Supply Regulations 1935.

  6. This licence shall, unless sooner lawfully determined, continue in force until the 31st day of March 1986.

  7. The Orders in Council specified in the Second Schedule hereto, authorising the licensee to erect and use electric lines, are hereby revoked.

ELECTRIC LINES AND AREA OF SUPPLY

  1. Electric lines for the supply of electrical energy within the Wanganui-Rangitikei Electric Power District as defined in the Third Schedule to the Proclamation, dated the 8th day of November 1965, and published in the Gazette on the 18th day of the same month, at page 2041.

  2. Electric lines for the supply of electrical energy commencing at the boundary of the Wanganui-Rangitikei Electric Power District, and proceeding thence in a north-easterly direction generally to a point on Waipuna Road, in the area of supply of the Raetihi Borough Council, the said lines being shown by means of red lines on the plans marked N.Z.E.D. 698/1 and 698/2, deposited in the office of the New Zealand Electricity Department at Wellington.
