CHARITABLE TRUST ACT 1957
NOTICE is hereby given, as required by section 36 of the Charitable Trust Act 1957, that the trustees for the time being of the Grand Lodge of Antient Free and Accepted Masons of New Zealand, within the meaning of the Grand Lodge of Freemasons of New Zealand Trustees Act 1903 (hereinafter termed “the applicants”), have applied to the Supreme Court at Auckland, seeking approval to a scheme for the alteration of certain trusts as follows:
The applicants hold, in trust, firstly, certain land and buildings at Papakura, generally known as the Papakura Boys’ Home, which was established by the late Frederick Seymour Potter as a home for orphan boys; and, secondly, certain funds and assets with which he endowed it.
Briefly, the purpose of the scheme is to extend the benefits of the trusts to enable the applicants:
-
To permit the use of the said property at Papakura, from time to time, as a home, school, or hostel for housing, maintaining, and educating delicate, ill, ailing, or backward children.
-
To use and apply the annual net income from the endowment funds in aiding, and assisting any incorporated charitable organisation operating in the Auckland Provincial District, having among their objects the promotion of the physical, educational, economic or social welfare of orphans, destitute, handicapped, or necessitous children generally.
-
To pay out of the trust assets all reasonable expenses of, and incidental to, preparing and advertising the scheme and making applications to the Court, including the costs and expenses of the Attorney-General.
Details of the application, the scheme, and the Attorney-General’s report thereon are open for inspection by the public, without fee or charge, at the office of the Registrar, Supreme Court, Waterloo Quadrant, Auckland.
The application seeking approval of the aforesaid scheme will be heard in the Supreme Court at Auckland on Monday, the 21st day of November 1966, at 9.30 a.m., or so soon thereafter as the applicants may be heard. Any person desiring to oppose the aforesaid scheme shall give notice, in writing, of his intention to do so to the Registrar of the Supreme Court at Auckland, as aforesaid, and to the applicants, care of Messrs Vialoux and Vialoux, Solicitors, 418 New Zealand Insurance Building, 105 Queen Street, Auckland, and the Attorney-General, Wellington, not less than seven clear days before the aforesaid date of hearing.
Dated at Auckland this 12th day of October 1966.
