set forth to take and use from Rangitukia Stream (hereinafter referred to as the said stream) situated in Section 157, Block XV, Alexandra Survey District, in the land district of Auckland, for the purposes hereinafter set forth, a stream of water not exceeding three cubic feet per second at any one time.

CONDTIONS

IMPLIED CONDITIONS

  1. The conditions directed to be implied in all licences by the Waterpower Regulations 1934 and the Electrical Supply Regulations 1935, shall be incorporated in, and shall form part of, this licence, except in so far as the same may be inconsistent with the provisions hereof.

LICENCE SUBJECT TO REGULATIONS

  1. The licence is issued under the Waterpower Regulations 1934, the Electrical Wiring Regulations 1961; the Electrical Supply Regulations 1935, and the Radio Interference Regulations 1958, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.

UTILISATION OF WATER AND LOCATION OF HEADWORKS

  1. Water shall be used under this licence solely for the purpose of generating electricity and shall be taken from the said stream at a point in Section 157, Block XV, Alexandra Survey District, in the Auckland Land District, indicated on the plan marked N.Z.E.D. 677; deposited in the office of the New Zealand Electricity Department, Wellington.

GENERAL DESCRIPTION OF WORKS

  1. The licensee is hereby authorised, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this licence; the positions of the said works being indicated on the said plan N.Z.E.D. 677:

(a) Headworks consisting of a dam and intake with a water race leading to the Pelton wheel and powerhouse, hereinafter referred to; giving a static head of approximately 75 ft;

(b) A powerhouse, with all necessary equipment, for generating electricity;

(c) A pipeline leading from the said powerhouse back to the said stream.

SYSTEM OF SUPPLY

  1. The system of supply shall be as described in paragraph (d) of clause 21-01 of the Electrical Supply Regulations 1935.

DURATION OF LICENCE

  1. Unless sooner determined, this licence shall continue in force until the 31st day of March 1987; or until electrical energy is available from an electric power board or other general public source, whichever is the earlier.

RENTAL

  1. For the purpose of assessing rental or the annual sum payable in respect of this licence, the present plant is rated at 7·5 kilowatts.

NO RIGHT TO WATER CONFERRED

  1. Nothing in this licence shall of itself confer upon the licensees any right to water.

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and with the consent of the licensees, hereby revokes the Order in Council dated the 11th day of November 1953, and published in the Gazette on the 19th day of November 1953, at page 1890, authorising Hilda Florence Ralston, of Ngamatapouri, married woman, Frederick Collett Matthews, Leslie Owen Matthews, Raymond Haddow Matthews, and Mervyn Bentley Matthews; all of Ngamatapouri, farmers, to use water for the purpose of generating electricity.
