Authorising Alexander Thomas Urquhart, of Lake Heron, Mount Somers, Farmer, to Use Water for the Purpose of Generating Electricity

At the Government Buildings at Wellington this 11th day of October 1965

Present:

THE RIGHT HON. KEITH HOLYOAKE, C.H., PRESIDING IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to Alexander Thomas Urquhart, of Lake Heron, Mount Somers, a farmer (hereinafter referred to as the licensee), a licence, subject to the conditions hereinafter set forth to take and use from an unnamed stream (hereinafter referred to as the said stream), situated in Section 33992, Block XI, Heron Survey District, for the purposes hereinafter set forth, a stream of water not exceeding 2 cu. ft. per second at any one time.


CONDITIONS

IMPLIED CONDITIONS

  1. The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.

LICENCE SUBJECT TO REGULATIONS

  1. This licence is issued under the Water Power Regulations 1934, and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1961, the Radio Interference Regulations 1958, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.

UTILISATION OF WATER AND LOCATION OF HEADWORKS

  1. Water shall be used under this licence solely for the purpose of generating electricity, and shall be taken from the said stream at the point in Section 33992, Block XI, Heron Survey District, indicated on the plan marked N.Z.E.D. 680 deposited in the office of the New Zealand Electricity Department at Wellington.

GENERAL DESCRIPTION OF WORKS

  1. The licensee is hereby authorised, subject to the condition hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being indicated on the said plan N.Z.E.D. 680.

(a) Headworks consisting of a small water race set at slightly lower level at the point of diversion and pipeline leading to the powerhouse hereinafter referred to, giving a static head of approximately 107 ft.

(b) Water wheel and powerhouse with all necessary equipment for generating electricity, situated in Section 33992, Block XI, Heron Survey District.

(c) Tail race leading from the said powerhouse to Lake Heron.

SYSTEM OF SUPPLY

  1. The system of supply shall be as described in paragraph (d) of regulation 21-01 of the Electrical Supply Regulations 1935 and shall be an alternating current system.

DURATION OF LICENCE

  1. Unless sooner lawfully determined this licence shall continue in force until the 31st day of March 1986, or until a supply of electricity is available from an electric power board or other public source of supply, whichever is the earlier.

RENTAL

  1. For the purpose of assessing the rental or annual sum payable in respect of this licence, the present plant is rated at 9 kilowatts.

NO RIGHT TO WATER CONFERRED

  1. Nothing in this licence shall of itself confer upon the licensee any right to water.

Appointing Members of the Special Town and Country Planning Appeal Board

PURSUANT to section 39A of the Town and Country Planning Act 1953, I, Brigadier Sir Bernard Edward Fergusson, the Governor-General of New Zealand, hereby appoint:

Cuthbert Hargreaves Taylor, Esquire, of Wellington, being a Barrister and Solicitor of the Supreme Court of New Zealand;

Leslie Porter Blunt, Esquire, of Kaikoura, being a person nominated by the Executive Committee of the New Zealand Counties Association, Incorporated;

Ewart Somers, Esquire, of Christchurch, being a person nominated by the Executive Committee of the Municipal Association of New Zealand Incorporated; and

Rex Ryerson Beaumont, Esquire, of Lower Hutt, Barrister and Solicitor;

to be members of the Special Town and Country Planning Appeal Board for a period commencing on the 1st day of November 1965 and terminating on the 8th day of July 1966; and I hereby appoint Cuthbert Hargreaves Taylor, the Deputy Chairman of the Town and Country Planning Appeal Board, to be Chairman of the Special Town and Country Planning Appeal Board.
