Notice No. 2 (1965) of the Trade Practices and Prices Commission

In the matter of the Trade Practices Act 1958 and in the matter of an inquiry into an alleged practice relating to price lists for retreaded and recapped tyres.

WHEREAS the Trade Practices and Prices Commission has, pursuant to section 18 of the Trade Practices Act 1958, conducted an inquiry into an alleged agreement or arrangement in respect of retreaded and recapped tyres between members of the New Zealand Tire Retreaders Association Incorporated (hereinafter referred to as “the association”):

And whereas prior to the said inquiry the Examiner of Trade Practices and Prices presented to the Commission a report pursuant to section 17 of the Trade Practices Act 1958 and a reply thereto was filed by the association:

And whereas in the report of the said Examiner it was alleged that the members of the association were parties to an agreement or arrangement under which the said members agreed (a) to fix the retail prices for retreading and recapping tyres and for the sale of retreaded and recapped tyres and (b) to fix the rates of discount to be allowed by members to users and resellers of such tyres:

And whereas the Commission heard evidence adduced by the Examiner and the association and heard Mr G. S. Orr of Counsel for the Examiner and Mr R. A. Young of Counsel for the Association:

And whereas the Commission has found that an agreement or arrangement (a) to fix the retail prices for retreading and recapping tyres and for the sale of retreaded and recapped tyres and (b) to fix the rates of discount to be allowed by members to users and resellers exists and that it is a trade practice substantially in terms of section 19 (2) (b) of the Trade Practices Act 1958:

And whereas the Commission has further found that the said agreement or arrangement is contrary to the public interest in terms of section 20 (d) of the Trade Practices Act 1958 and further that an order should be made under the said Act in respect of the said trade practice:

And whereas, following the decision of the Commission as aforesaid made on the 29th day of April 1965, the members of the association held a special general meeting of the association at Wellington on the 15th day of June 1965 and passed thereat the following resolutions—
(1) That clause 2 (c) of the rules of the association be revoked;
(2) That the association abandon its memorandum entitled “Practices and Procedures for the Guidance of Members” (usually referred to as “The Code of Ethics”):

Now, therefore, the Trade Practices and Prices Commission, pursuant to sections 19 and 21 of the Trade Practices Act 1958, hereby orders and directs the members of the association—
(i) To discontinue the said agreement or arrangement found by the Commission to exist as aforesaid, and
(ii) To refrain from reviving the said agreement or arrangement in any form whether as members of the association or otherwise howsoever and to refrain from entering into any other agreement or arrangement which would have substantially the same effect:

And hereby further orders the association to write to all members of the association within 14 days of the coming into effect of this order advising them of the terms of the said resolutions passed at the aforesaid special general meeting held on the 15th day of June 1965 and further advising them that henceforth it will be the personal responsibility of each member without consultation with any other member to fix the prices and discounts for retreading and recapping tyres and for the sale of retreaded and recapped tyres.
