β¨ City of Manukau Constitution

- (a) For the purposes of representation only, the said city shall be divided into five wards to be known as the Mangere, Otara, Manurewa, Pakuranga, and Clevedon Wards which shall comprise those areas described in the Second, Third, Fourth, Fifth, and Sixth Schedules hereto respectively.
(b) There shall be 18 members of the council of the said city, exclusive of the Mayor, and the ward representation shall be as follows:
Mangere Ward ..... 4 members
Otara Ward ..... 3 members
Manurewa Ward ..... 6 members
Pakuranga Ward ..... 4 members
Clevedon Ward ..... 1 member

Until the Mayor and members of the council of the said city to be elected on the date prescribed by law for the triennial general elections of members of borough councils next following the date of constitution of the said city come into office the council of the said city shall consist of the members of the existing council of the County of Manukau and the Mayor and the members of the existing council of the Borough of Manurewa in office on the 2nd day of September 1965.

In the event of any vacancy, other than a vacancy in the office of Mayor, occurring in the council of the said city prior to the said triennial general elections such vacancy may be filled by the appointment of a member to be nominated by the appropriate committee established in accordance with clause 8 of this order.

The Returning Officer for the present County of Manukau shall be responsible for calling the first meeting of the council of the said city.

Until the 31st day of March 1966 the said city shall, for the purposes of finance only, be divided into eight subdivisions as follows:
Manukau Subdivision: Comprising generally the area of the existing County of Manukau with the exception of the the County Towns hereunder named.
Manurewa Subdivision: Comprising generally the area of the existing Borough of Manurewa.
Mangere Bridge Subdivision: Comprising generally the area of the existing County Town of Mangere Bridge.
Mangere East Subdivision: Comprising generally the area of the existing County Town of Mangere East.
Pakuranga Subdivision: Comprising generally the area of the existing County Town of Pakuranga.
Buckland and Eastern Beaches Subdivision: Comprising generally the area of the existing County Town of Buckland and Eastern Beaches.
Beachlands Subdivision: Comprising generally the area of the existing County Town of Beachlands.
Maraetai Subdivision: Comprising generally the area of the existing County Town of Maraetai.
- (a) Until the date prescribed by law for the triennial general elections of members of borough councils next following the date of constitution of the said city, the council of the said city shall, pursuant to section 63 of the Municipal Corporations Act 1954, appoint a committee for each of the subdivisions constituted in accordance with the provisions of clause 7 of this order together with a subdivision to be known as the Otara Subdivision, comprising generally the area of the existing County Town of Otara which shall, for the purposes of this clause, be excluded from the Manukau Subdivision.
(b) The membership of the said committees shall be:
Manukau Committee: The members of the existing council of the County of Manukau.
Manurewa Committee: The members of the existing council of the Borough of Manurewa.
Mangere Bridge Committee: The members of the existing committee of the County Town of Mangere Bridge.
Mangere East Committee: The members of the existing committee of the County Town of Mangere East.
Pakuranga Committee: The members of the existing committee of the County Town of Pakuranga.
Buckland and Eastern Beaches Committee: The members of the existing committee of the County Town of Buckland and Eastern Beaches.
Beachlands Committee: The members of the existing committee of the County Town of Beachlands.
Maraetai Committee: The members of the existing committee of the County Town of Maraetai.
Otara Committee: The members of the existing Committee of the County Town of Otara.

Until the 31st day of March 1966 the debit and credit balances in the general, separate, and special fund accounts, the stocks in hand, sundry debtors, and the liabilities of the existing Borough of Manurewa as at the date of constitution of the said city shall be credited and debited to the separate account of the subdivision formed from the district of that borough, and similarly those of the existing County of Manukau shall be credited and debited to a joint separate account in the names of the subdivisions comprising the areas of the existing county towns and the remainder of that county, the said subdivisions being in all cases those described in clause 7 hereof; and all receipts and expenditure shall be credited and debited similarly.

Until the 31st day of March 1966 all moneys in the said separate account and the said joint separate account shall be paid into separate bank accounts.

All rates levied in the districts of the existing county of Manukau and the existing Borough of Manurewa shall be consolidated over the whole district of the said city from the 31st day of March 1966:
Provided that those areas of the district of the existing County of Manukau situated outside the inner area of the Drainage Division of the Auckland Regional Authority shall not be subject to sewerage rates.

The assets and liabilities of the existing County of Manukau and the existing Borough of Manurewa shall become the assets and liabilities of the said city.

All staff employed by the councils of the existing County of Manukau and the existing Borough of Manurewa on 2 September 1965 shall be taken over by the council of the said city and shall be employed for a minimum period of two years without loss of salary or wages. Any agreements in relation to superannuation which are in operation between such existing staff and their respective existing councils shall be continued by the council of the said city. This provision shall be in addition to and subject to the provisions of the Local Authorities (Employment Protection) Act 1963.

All the valuation rolls, electors lists, electors rolls, and rate books in force in the the existing County of Manukau and the existing Borough of Manurewa shall continue in force in the said city until new valuation rolls, electors lists, electors rolls, and rate books respectively are made for the said city pursuant to the Municipal Corporations Act 1954.

All property and the control of any land or thing vested in the council or corporation of the existing County of Manukau or in the council or corporation of the existing Borough of Manurewa shall at the date of constitution of the said city be vested in the council or corporation of the said city; and all liabilities and engagements of those corporations or of either of them, and all proceedings pending by or against either of those corporations, shall respectively be liabilities and engagements of, and proceedings to be carried on by or against the corporation of the said city.

All bylaws in force in the district of the existing County of Manukau and in the district of the existing Borough of Manurewa which are applicable to the altered circumstances shall at the date of constitution of the said city become bylaws of the said city, and may be revoked or altered by the council of the said city, but until so revoked or altered every such bylaw shall remain in force in the area in which it was in force prior to the date of constitution of the said city; and every bylaw which cannot be restricted to any particular area shall be deemed inapplicable, and all bylaws which are inapplicable to the altered circumstances shall be deemed to have been revoked as at the day of constitution of the said city.

The existing members of the fire committee of the Manurewa Urban Fire District elected by the council of the existing Borough of Manurewa shall continue in office as members of that Committee until the 31st day of December 1965.

ALL that area in the North Auckland Land District bounded by a line commencing at a point in the middle of the North Island Main Trunk Railway in line with the northern side of Portage Road in Block VI, Otahuhu Survey District, and proceeding southerly along the western and southern boundaries of the Borough of Otahuhu as described in New Zealand Gazette, 1922, page 273, to and south-easterly along the north-eastern boundary of Section 37, Block VI, Otahuhu Survey District, to and generally southerly, easterly, northerly, and then westerly along the western, southern, eastern, and northern boundaries of the Borough of Papatoetoe as described in New Zealand Gazette, 1960, page 1058, to the line of mean highwater on the right bank of the Otaki Creek; thence northerly generally along that line of mean high water on the right bank of that creek and of the Tamaki River to East Tamaki Head (Musick Point); thence south-easterly generally along the shores of the Hauraki Gulf to and south-westerly and then easterly along the north-western and southern boundaries of the Borough of Howick as described in New Zealand Gazette, 1960, page 1060, to and again along the shores of the said gulf to the middle of the mouth of the Puwhenua Stream in Block II, Wharekawa Survey District; thence westerly generally up the middle of that stream to a point in the middle of a part of the said stream forming the generally south-eastern boundary of Wharekawa 5c, in line with the northern boundary of the said 5c; thence to and along that northern boundary, and the northern boundaries of Wharekawa 5B North 8, 5B North 2, and 5B North 1, and northerly along the eastern boundaries of Allotments 102 and 148, Otau Parish, to and north-easterly and again westerly generally along the south-eastern and northern boundaries of Lot 1, D.P. 29892, to and along the northern side of a public road forming the generally southern and south-eastern boundaries of Allotments 95 and 96, to and along the southern boundary of the said Allotment 96, along a right line being the last-mentioned boundary produced to the eastern boundary of Allotment 88, and along that eastern boundary to and along the north-eastern and north-western boundaries of Allotment 89, the northern boundaries of Lot 2, of Allotment 90, and part Allotment 67, the aforesaid allotments being of Otau Parish, to and along the eastern and northern
