The Thames Borough Council Water Power and Electric Lines Licence 1965
H.E. BARROWCLOUGH, Administrator of the Government ORDER IN COUNCIL
At the Government House at Wellington this 11th day of August 1965 Present:
His Excellency The Administrator of the Government IN COUNCIL PURSUANT to the Public Works Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER

  1. This order may be cited as the Thames Borough Council Water Power and Electric Lines Licence 1965.
  2. Subject to the conditions hereinafter set forth, the Thames Borough Council (hereinafter referred to as the licensee) is hereby granted a licence to take and use from the Thames Borough water supplies and reservoirs in the South Auckland Land District, for the purpose hereinafter set forth, a stream of water and also to lay, construct, put up, place, and use the electric lines described in the First Schedule hereto.
  3. The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated herein and shall form part of this licence, except in so far as they may be inconsistent with the provisions of this licence.
  4. This licence is issued under the Water Power Regulations 1934, and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1961, the Radio Interference Regulations 1958, and to all regulations made in amendment thereof or in substitution therefor, except in so far as they may be inconsistent with the provisions of this licence. Provided that the licensee shall not by virtue of this clause be required, except in the course of alteration, repair, or maintenance, to reconstruct in conformity with the regulations hereinbefore mentioned any electric lines or works which conformed to the regulations in force at the time of the construction thereof.
  5. The water shall be taken from the 30in. water main from the Thames Borough water supply near the junction of Bella Street and Waiokarak Road in the Borough of Thames at a point marked on the plan marked N.Z.E.D. 662 deposited in the office of the New Zealand Electricity Department at Wellington. The water shall be used solely for the purpose of generating electricity.
  6. The licensee is hereby authorised, subject to the conditions hereof, to construct, maintain, and use the works described in the Second Schedule hereto, the position of the said works being indicated on the said plan N.Z.E.D. 662.
  7. The systems of supply shall be as described in paragraphs (a), (b), (c), (d), (e), and (f) of regulation 21-01 of the Electrical Supply Regulations 1935.
  8. Nothing in this licence shall of itself be deemed to confer upon the licensee any right to water.
  9. This licence shall, unless sooner lawfully determined, continue in force until the 31st day of March 1986.
  10. The Orders in Council specified in the Third Schedule hereto are hereby revoked.
    FIRST SCHEDULE
    LINES and works for the supply of electrical energy within the Borough of Thames, as constituted on the 26th day of January 1921, as outlined by a dotted red line on the said plan N.Z.E.D. 662.
    SECOND SCHEDULE
    GENERAL DESCRIPTION OF GENERATING WORKS
    (a) Pipeline leading from the said water supply reservoir to the powerhouse hereinafter referred to.
    (b) Powerhouse with water turbines, generators, and all necessary equipment for generating electricity having a maximum capacity of 122 kilovolt-amperes.
    (c) Tail race from the powerhouse aforesaid to the Firth of Thames.
    All as indicated on the said plan N.Z.E.D. 662.

    His Excellency The Administrator of the Government IN COUNCIL PURSUANT to the Local Authorities Loans Act 1956, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto by way of loan of the whole or any part of the respective amounts specified in that Schedule.
