HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL
PURSUANT to section 131 of the Public Works Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby amends the resolution passed by the Taieri County Council on the 1st day of June 1962, contained in memorandum of acceptance 284250, Otago Land Registry, by cancelling the building-line condition imposed by the said resolution and accepted by the said memorandum of acceptance in so far as it affects the northern, southern, eastern, and western sides of the road adjoining Sections 9, 10, 1 of 11, and 2 of 11, Block V, Otokia Survey District, the said road being more particularly delineated on the plan marked M.O.W. 19501 (S.O. 13590), deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

Authorising the Manukau County Council to Reclaim Land From the Tamaki River

PURSUANT to section 175 of the Harbours Act 1950, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby authorises the Manukau County Council to reclaim from the Tamaki River an area of 3 roods 15 perches, more or less, as shown coloured red on plan marked M.D. 12045 and deposited in the office of the Marine Department at Wellington.

Appointment of Commission to Inquire Into Riot at Auckland Prison

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL
PURSUANT to the Commissions of Inquiry Act 1908, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby appoints
Alan Aylmer Coates, Esquire, Stipendiary Magistrate of Auckland
to be a Commission to inquire into and report to the Governor-General in writing upon all the circumstances of the happenings at Auckland Prison on the 20th and 21st days of July 1965 (hereinafter in this Order in Council referred to as “the riot”), and in particular:
(1) The causes of the riot, and whether and to what extent it was planned:
(2) The objects which those taking part in the riot sought to attain:
(3) The course of events leading up to and during the riot:
(4) Whether, and if so in what respect and to what extent, the practices in force and the procedures followed at Auckland Prison contributed to the commencement or continuation of the riot:
(5) Whether any breach of duty or failure to observe proper practices and procedures by any officer or employee of the Prisons Service contributed to the commencement or continuation of the riot, and if so in what respect and to what extent:
(6) Whether all possible measures were taken to prevent the riot, to restrict its extent, to minimise the damage done to property, and to put an end to the riot, and if not in what respect and to what extent the measures taken were inadequate:
(7) Whether all possible measures were taken to ensure the safety of the public, and if not in what respect and to what extent the measures taken were inadequate:
(8) Such other matters in relation to the riot and to the administration of Auckland Prison as may be brought to the notice of the Commission or initiated by it, and as may be deemed by it to be relevant to its purposes as defined in paragraphs (1) to (7) above.

Ernest Albert Lee, Esquire, Stipendiary Magistrate of Christchurch
