City of Whangarei and Town District of Kamo Abolished, City of Whangarei Constituted, and Boundaries of County of Whangarei Altered

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Local Government Commission Act 1961, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER
-
As from the 1st day of July 1965 the City of Whangarei and the Town District of Kamo shall be abolished and the Councils of the City of Whangarei and the Town District of Kamo shall be dissolved.

The areas described in the First, Second, Third, Fourth, Fifth, Sixth, and Seventh Schedules hereto shall be excluded from the County of Whangarei.

The area described in the Eighth Schedule hereto shall be included in the County of Whangarei.

The area described in the Ninth Schedule shall be constituted a borough to be known as the City of Whangarei hereinafter referred to as the said city.

For the purpose of representation and finance the said city shall, for a period of not less than three years but not exceeding 10 years from the date of the constitution of the said city, be divided into two wards as follows:
(i) The Whangarei Ward comprising the area of the existing City of Whangarei together with the areas described in the First Schedule, Section A of the Second Schedule, and the Fifth, Sixth, and Seventh Schedules hereto; and
(ii) The Kamo Ward comprising the area of the existing Kamo Town District together with the areas described in Section B of the Second Schedule and the Third and Fourth Schedules hereto, but excluding the area described in the Eighth Schedule hereto.
- The number of members of the Council of the said city shall, for a period of not less than three years but not exceeding 10 years, be 14, exclusive of Mayor, to be elected as follows:
For the Whangarei Ward, 11 members.
For the Kamo Ward, three members.

The first election of the Mayor and members of the Council of the said city shall be held on the date prescribed by law for the next triennial general elections of mayors and members of borough councils.

Until the first Mayor of the said city to be elected as aforesaid shall come into office, the Mayor of the existing City of Whangarei shall be Mayor of the said city.

Until the members of the Council of the said city elected at the said first election come into office, the said Council shall comprise 11 members of the present Council of the City of Whangarei to be chosen by that Council to represent the Whangarei Ward, and three members of the present Council of the Town District of Kamo to be chosen by that Council to represent the Kamo Ward.

Reginald Charles Major of Whangarei shall be the Town Clerk and Returning Officer of the said city.

The said abolitions, the said constitution, and the said alteration of boundaries hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.
FIRST SCHEDULE
ALL that area of approximately 2,610 acres in the North Auckland Land District, Whangarei County, bounded by a line commencing at the southernmost corner of Lot 2, D.P. 46220, in Block XVI, Purua Survey District, and proceeding north-easterly along the south-eastern boundaries of that Lot 2, Lot 4, D.P. 19724, and Lot 17, Deeds Plan 130, to and easterly and then southerly generally along the generally southern boundary of Whangarei City as proclaimed in Gazette, 1964, page 803, and described in Gazette, 1960, page 2003, to a point in Block XIII, Whangarei Survey District, due east of another point 1000 links due south of the south-eastern corner of Section 5, Block XIII, aforesaid; thence due west to a point due south of another point, on the north-western side of the North Auckland Railway, distant 750 links, measured in a south-westerly direction along that north-western side, from the north-eastern boundary of Te Rewarewa B 2; thence due north to and along the north-western side of that railway and westerly along the generally northern boundaries of Te Rewarewa B 2 and B 1B and south-westerly generally along the north-western boundary of Te Rewarewa B 1A 3A, and that boundary produced to and along the north-western boundaries of Te Rewarewa B 1A 2 and B 1A 1 and the western and south-western boundaries of Te Rewarewa A, to and up the middle of the Te Waiti Stream, to and southerly along the western side of State Highway No. 1, to and along the south-eastern boundary of Lot 1, D.P. 33086, to a point in line with the south-western boundary of Lot 2, D.P. 40082; thence north-westerly to and along the last mentioned boundary, south-westerly along the north-western boundary of the said Lot 1, D.P. 33086, and again north-westerly along the north-eastern boundaries of Section 22, Block XVI, Purua Survey District, Ruarangi Block, and Section 20 of that Block XVI to the point of commencement.
SECOND SCHEDULE
SECTION A
ALL that area of approximately 440 acres in the North Auckland Land District, Whangarei County, bounded by a line commencing at a point on the eastern boundary of the Kamo Town District on Block VIII, Purua Survey District, in line with the south-eastern boundary of Lot 33, D.P. 49379, and proceeding north-easterly generally to and along that boundary and continuing along the north-western and north-eastern sides of Corks Road, to and along the north-western boundaries of Lot 57, D.P. 49379, and the north-eastern boundaries of that Lot 57 and Lot 58, D.P. 49379, and the north-western boundary of Allotment 99, Whangarei Parish, to a point 250 links distant from and measured at right angles to the said north-eastern side of Corks Road; thence south-easterly along a right line parallel to that roadside to and easterly along the southern side of the Whangarei-Kiripaka road, to and southerly generally along the north-eastern boundary of Lot 1, D.P. 25044, to the western side of a public road; thence along a right line to the northernmost corner of Lot 2, D.P. 25044, and along the north-eastern and south-eastern boundaries of that Lot 2 and the generally southern boundaries of Lot 3, D.P. 25044, and the eastern and south-eastern sides of a public road forming the generally eastern boundaries of Lot 16, D.P. 3129, Lot 3, D.P. 40364, Lots 18, 19, 20, and 21, D.P. 3129, and forming the south-eastern boundaries of part Lot 11, D.P. 3129, and Lots 51 to 56 (inclusive), D.P. 50821, to and northerly generally along the generally eastern boundaries of Whangarei City as proclaimed in Gazette, 1964, page 803, and as described in Gazette, 1960, page 2003, and Kamo Town District as described in Gazette, 1929, page 385, to the point of commencement.
SECTION B
ALL that area of approximately 165 acres in the North Auckland Land District, Whangarei County, bounded by a line commencing at a point in the middle of Gillingham Road on the eastern boundary of Kamo Town District in Block VIII, Purua Survey District, in line with the south-eastern boundary of that part Allotment 50, Whangarei Parish, comprised in C.T. 1693/67 (limited as to parcels), and proceeding north-easterly to and along that boundary and then south-easterly generally along the right bank of the Waitaua Stream to the western side of Vinegar Hill Road in Block V, Whangarei Survey District; thence southerly along that western side to and south-westerly generally along the north-western boundary of Allotment 99, Whangarei Parish, to and along the north-eastern boundaries of Lots 58 and 57, D.P. 49379, and the north-western boundaries of the said Lot 57 to and north-westerly and then south-westerly along the north-eastern and north-western sides of Corks Road and along the production of the south-eastern boundary of Lot 33, D.P. 49379, to and north-westerly along the boundary of Kamo Town District as described in Gazette, 1929, page 385, to the point of commencement.
THIRD SCHEDULE
ALL that area of approximately 155 acres in the North Auckland Land District, Whangarei County, bounded by a line commencing at a point on the western boundary of Kamo Town District in Block VIII, Purua Survey District, in line with the north-western boundary of Ngamokotuaitara 2, and proceeding southerly generally along the town district boundary as described in Gazette, 1929, page 385, to and along the western boundary of Whangarei City as proclaimed in Gazette, 1964, page 803, and as described in Gazette, 1960, page 2003, to its intersection with the northern boundary of Lot 2, D.P. 45066; thence westerly and northerly along the generally northern boundary of that Lot 2, to and along the eastern and northern boundaries of Lot 1, D.P. 45066, and along the western boundary of Lot 1, D.P. 43540, to the southernmost corner of part Lot 2, D.P. 39273; thence north-westerly along the south-western boundaries of that part Lot 2, and of Lots 11, 10, 9, 8, 7, 6, 5, 4, 3, and 1, D.P. 52362, and along the last-mentioned boundary produced across Three Mile Bush Road to its northern side; thence along that side to and along the south-western boundary of part Otapapa Block shown on D.P. 4543, and along that boundary produced to the south-eastern boundary of Ngatapapa 2; thence north-easterly generally along that boundary, and along a right line crossing a public road to the intersection of the eastern side of that road with the middle of the Otapapa Stream, and down the middle of that stream to a point in line with the northern boundary of Lot 11, D.P. 44008; thence to and along that northern boundary, to and along the south-western boundaries of Lots 12, 13, 14, and 15, D.P. 44008, and Lot 1, D.P. 52017, the south-western and north-western boundaries of Lot 20, the north-western and north-eastern boundaries of Lots 29, 30, and 31, and the north-western and north-eastern boundaries of Lot 32, all of D.P. 44008 aforesaid, to and along the north-western boundary of Ngamokotuaitara 2, aforesaid, and that boundary produced to the point of commencement.
