PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the road described in the Schedule hereto shall, on and after the date of this Order in Council, become county road.


SCHEDULE

WESTLAND LAND DISTRICT

ALL that portion of road situated in Block II, Poerua Survey District, commencing from the northern corner of Rural Section 4307 and proceeding in a south-easterly direction generally along the north-eastern boundary of the said Rural Section 4307 for a distance of approximately 23 chains and terminating at a point approximately 23 chains from the south-eastern corner of the said Rural Section 4307; as the same is more particularly delineated on the plan marked M.O.W. 18900 (S.O. 5138) deposited in the office of the Minister of Works at Wellington, and thereon coloured red and marked A–B.

Boundaries of Inner Area of Auckland Metropolitan Drainage District Altered

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Auckland Metropolitan Drainage Act 1960, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.


ORDER

ON and from the 1st day of April 1965, the boundaries of the Inner Area of the Auckland Metropolitan Drainage District are hereby altered so as to exclude from the Inner Area the area described in the Schedule hereto.


SCHEDULE

ALL that area in the North Auckland Land District, Waitemata County, bounded by a line commencing on the southern side of the North Auckland Main Trunk Railway, in Block XIII, Waitemata Survey District, at the westernmost corner of Allotment 121, Waipareira Parish, and proceeding easterly generally along the said side of that railway to a point in line with the eastern side of Candia Road; thence southerly to and along that roadside, to and westerly and then northerly along the boundary of the Inner Area of the Auckland Metropolitan Drainage District as described in Gazette 1958, page 868, to the point of commencement.

Granting Control of the Foreshore at Foxton Beach to the Manawatu County Council

At the Government House at Wellington this 17th day of November 1964

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to the Manawatu County Council (hereinafter called the council) control of part of the foreshore as described in the First Schedule hereto, subject to the terms and conditions set forth in the Second Schedule hereto.


FIRST SCHEDULE

DESCRIPTION OF AREAS

ALL that portion of the foreshore of the sea commencing on a line extending due west of the point where the sea coast meets the right bank of the Manawatu River in Block II, Moutere Survey District, and proceeding northerly to a line extending due west from the northernmost corner of Section 270, Town of Foxton, in Block I, Moutere Survey District, as shown on S.O. plan 12963.

As the same is shown coloured red between positions marked “A” and “B” on the plan marked M.D. 11917, and deposited in the office of the Marine Department at Wellington.


SECOND SCHEDULE

CONDITIONS

  1. In these conditions the term “Foreshore” means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides. “Minister” means the Minister of Marine as defined by the Shipping and Seamen Act 1952, and includes any officer, person, or authority acting by or under the direction of such Minister.
