District Scheme Change Approved

PURSUANT to the Town and Country Planning Act 1953 and the Town and Country Planning Regulations 1960, public notice is hereby given of the subject matter of an application consented to by the Town and Country Planning Appeal Board as stated hereunder:

Under section 35 of the above-mentioned Act:

Applicant: L. D. Hanratty Ltd.

Terms of Consent: Specified departure permitting the applicant to erect on the land described in the Schedule hereto and in respect of which the applicant is a conditional purchaser a factory having a floor space not exceeding 7500 sq. ft. on the ground floor and not exceeding 2500 sq. ft. on the first floor and by permitting the applicant to retain on the said land the existing house for the use as an amenity block in conjunction with the proposed factory.

SCHEDULE

ALL that piece of land situate at 40 Ward Street, in the Borough of Upper Hutt, containing 40 perches (40p.), more or less, being Lot 1, on Deposited Plan No. 2636, part of Section 98, of the Hutt District, and all the land contained in certificate of title, Volume 271, folio 53 (Wellington Registry).

Effective date: 1 October 1964.

The consent of the Town and Country Planning Appeal Board is contained in Appeal No. 255/64.

Public Notification of Change No. 29 of Papakura District Scheme

PUBLIC notice is hereby given that pursuant to a resolution of the Papakura Borough Council made on 12 October 1963, the following change of the Papakura District Scheme has been recommended for approval under the Town and Country Planning Act 1953, Lots 1 and 2, D.P. 40489, part E111. Lot 2, D.P. 52636, Lots 1–11, D.P. 42996, situated Great South Road, Papakura, to be changed from Rural A (proposed) to Residential A.

Plans showing the change of the scheme have been deposited at the offices of:

The Papakura Borough, Coles Crescent, Papakura,

The Public Library, East Street, Papakura,

The District Land Registrar, Auckland,

The Auckland Regional Planning Authority, Auckland,

in accordance with section 22 (i) of the Act and are there open for inspection, without fee, to all persons interested therein at any time when the above places are open to the public.

Objections to the change of the scheme shall be in writing in form E prescribed in the First Schedule to the Town and Country Planning Regulations 1960, and shall be lodged at the office of the council at any time not later than the 24th day of December 1964. At a later date every objection will be open for public inspection and any person who wishes to support or oppose any objection will be entitled to be heard at the hearing of objections if he notifies the Town Clerk in writing within the period of which public notice will be given.

Public Notification of Section 6 (Ahuriri Lagoon), Section 7 (Pirimai), of the City of Napier District Scheme

PUBLIC notice is hereby given that pursuant to regulations 18 (7) of the Town and Country Planning Regulations 1960, the Napier City Council has extended the closing date for objections to the provisions of Section 6 known as the Ahuriri Lagoon Section and Section 7 known as the Pirimai Sections of the Napier Scheme—both sections being formerly part of the Hawke’s Bay Extra Urban Planning Scheme No. 1. The sections of the district scheme have been deposited in the public library, the Town Clerk’s and City Engineer’s Offices, in accordance with section 22 (1) of the Town and Country Planning Act 1953 and are there open for inspection, without fee, to all persons interested therein at any time when the above places are open to the public.

Objections to these sections of the Napier District Scheme or to any part thereof shall be in writing in form E prescribed in the First Schedule of the Town and Country Planning Regulations 1960, and shall be lodged at the office of the council at any time not later than 4 p.m. on the 4th day of December 1964. At a later date every objection will be open for public inspection and any person who wishes to support or oppose any objection will be entitled to be heard at the hearing of objections if he notifies the Town Clerk in writing within the period of which public notice will be given.

PURSUANT to section 38 of the Local Authorities Loans Act 1956, notice is hereby given that a poll of the ratepayers of the Ohinemuri Water Supply Special Rating Area taken on 28 October 1964, on the proposal of the Ohinemuri County Council to borrow the sum of £44,150 for the purpose of renewing and extending the reticulation of the Ohinemuri Water Supply.

The number of votes recorded for the proposal was …… 139

The number of votes recorded against the proposal was 93

The number of informal votes was …… …… 2

I therefore declare that the proposal was carried.

THE CHARITABLE TRUSTS ACT 1957

NOTICE OF APPLICATION FOR APPROVAL OF SCHEME

IN the matter of the Charitable Trusts Act 1957, notice is hereby given as required by section 36 of the Charitable Trusts Act 1957, that Community Sunshine Association Incorporated (hereinafter called “the applicant”) has applied to the Supreme Court at Auckland seeking approval of a scheme for the disposal of its property as follows:

  1. The property of the association both real and personal shall, subject to the payment of all debts and obligations of the association and all the costs and expenses of the winding up of the association, be transferred and assigned to the Boystown Police and Citizens Club Incorporated freed and discharged from all trusts to which such property may previously have been subject, it being the purpose and intention of this scheme that the property of the applicant upon its vesting in the Boystown Police and Citizens Club Incorporated shall become assets of that club and shall be held and dealt with in or towards attaining the objects of that club in accordance with its rules.

  2. That all reasonable expenses or incidents to preparing and advertising the said scheme including the costs and expenses of the Attorney-General shall be paid out of the applicant’s assets.

Details of the application, the scheme, and the Attorney-General’s report thereon are open for inspection by the public, without fee or charge, at the office of the Registrar, Supreme Court, Waterloo Quadrant, Auckland.

The application seeking approval of the aforesaid scheme will be heard in the Supreme Court, at Auckland, on the 14th day of December 1964, at 10 a.m. or so soon thereafter as the applicant may be heard. Any person desiring to oppose the aforesaid scheme shall give written notice of his intention to do so to the Registrar of the Supreme Court at Auckland as aforesaid, and to the applicant care of its solicitor, Mr S. W. W. Tong, Dilworth Building, Customs Street, Auckland, and the Attorney-General, Wellington, not less than seven clear days before the aforesaid date of hearing.
