Licensing the Warkworth Town Council to Use and Occupy a Part of the Bed of the Mahurangi River at Warkworth as a Site for a Wharf
PURSUANT to the Harbours Act 1950, the Minister of Marine hereby licenses and permits the Warkworth Town Council (hereinafter called the Council, which term shall include its successors or assigns unless the context requires a different construction), to use and occupy a part of the bed of the Mahurangi River at Warkworth, as shown on plan M.D. 1163 and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon a wharf as shown on the said plan, such licence to be subject to the terms and conditions set forth in the First Schedule hereto; and hereby prescribes that the dues and rates specified in the Second Schedule hereto shall be taken and charged by the Council for the use of the said wharf.
FIRST SCHEDULE

This licence is subject to the Foreshore Licence Regulations 1960, and the provisions of those regulations shall, so far as applicable, apply hereto.

The master of every vessel discharging ballast at the said wharf shall have all such ballast taken away and deposited above high water mark or at such place as may be approved by the Minister or by any person appointed by the Minister for that purpose.

The annual sum payable by the Council shall be one shilling payable on demand.

The term of the licence shall be 14 years from the 1st day of July 1964.
SECOND SCHEDULE
WHARFAGE ON VESSELS
REGULAR trading steamers and sailing vessels, per half-year, if paid in advance per ton register ....... 6
Irregular trading vessels of any class, for each time they come alongside the wharf, for every day or part of a day.
Vessels up to 10 tons register ....... 1 6
Vessels over 10 tons register and up to 30 tons register ....... 2 6
Vessels over 30 tons register (per ton register) ....... 1
All vessels which do not pay their dues in advance will be deemed to be irregular trading vessels.
Vessels coming alongside of the wharf will be held responsible for any damage done to the wharf, and the said Council will repair any such damage and charge the cost of doing so against the master or owner of the vessel doing the damage.
The half-year will commence on the 1st days of January and July in each year.
The masters or owners of all regular trading vessels shall pay their dues in advance to the treasurer of the said Council.
All dues payable by irregular trading vessels shall be paid to the treasurer of the said Council, or to someone appointed by him to receive them, the payments to be made by the master or owner of the vessel upon the first application.
WHARFAGE ON GOODS
All goods (with the exception of shingle, metal, or lime) landed on or shipped from the wharf, per ton weight or measurement ....... 1 0
For all metal, shingle or lime landed on or shipped from the wharf or loading stage by any person, firm, company, or local authority, for loading only, per ton or cubic yard ....... 6
Minimum charge ....... 2
All goods not removed from the wharf within seven days will be charged 6d. per ton per week or part of a week.
PENALTIES
Any person, firm, or company which:
(1) Permits any offensive matter to be placed on or about the wharf premises; or
(2) Deposits the remains and/or the offal of fish about the wharf premises; or
