Authorising Bernard James Annabell and Rex Bernard Annabell, both of Makakaho, Waitotara, Farmers, to Use Water for the Purpose of Generating Electricity, and Revoking a Previous Licence

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to Bernard James Annabell and Rex Bernard Annabell, both of Makakaho, Waitotara, farmers (hereinafter referred to as the licensees), a licence, subject to the conditions hereinafter set forth, to take and use from the Makakaho Stream (hereinafter referred to as the said stream), situated in Section 5, Block VI, Moumahaki Survey District, in the County of Patea, for the purpose hereinafter set forth, a stream of water not exceeding 4 cu. ft. per second at any one time; and further hereby revokes the Order in Council dated the 18th day of February 1959 and published in the Gazette on the 26th day of February 1959, at page 236, authorising the licensees to use water for the purpose of generating electricity.
CONDITIONS IMPLIEd CONDITIONS
- The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.
LICENCE SUBJECT TO REGULATIONS
- This licence is issued under the Water Power Regulations 1934, and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1961, the Radio Interference Regulations 1958, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.
UTILISATION OF WATER AND LOCATION OF HEADWORKS
- Water shall be used under this licence solely for the purpose of generating electricity and shall be taken from the said stream at a point in Section 6, Block VI, Moumahaki Survey District, indicated on the plan marked N.Z.E.D. 644 deposited in the office of the New Zealand Electricity Department at Wellington.
GENERAL DESCRIPTION OF WORKS
- The licensees are hereby authorised, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being indicated in the said plan N.Z.E.D. 644
(a) Headworks consisting of an intake with a water race and pipeline leading to the powerhouse hereinafter referred to giving a static head of approximately 50 ft.
(b) Turbine and powerhouse with all necessary equipment for generating electricity, situated in Section 6, Block VI, Moumahaki Survey District.
(c) Tail race leading from the said powerhouse back to the said stream.
SYSTEM OF SUPPLY
- The system of supply shall be a direct current system as described in paragraph (d) of regulation 21-01 of the Electrical Supply Regulations 1935.
DURATION OF LICENCE
- Unless sooner lawfully determined, this licence shall continue in force until the 31st day of March 1979.
RENTAL
- For the purpose of assessing the rental or annual sum payable in respect of this licence the present plant is rated at 10 kW.
NO RIGHT TO WATER CONFERRED
- Nothing in this licence shall of itself confer upon the licensees any right to water.

Revoking a Licence Authorising Harding Brothers and Sons, of Owairaka Valley, Te Awamutu, to Use Water for the Purpose of Generating Electricity and to Erect and Use Certain Electric Lines
BERNARD FERGUSSON, Governor-General ORDER IN COUNCIL At the Government House at Wellington this 22nd day of July 1964 Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council and with the consent of the licensee, hereby revokes the Order in Council, dated the 6th day of July 1955 and published in the Gazette on the 7th day of the same month at page 1069, authorising Harding Brothers and Sons, of Owairaka Valley, Te Awamutu, to use water for the purpose of generating electricity and to erect and use certain electric lines.

The Amethyst Electric Power Board Electric Lines Licence 1964

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL PURSUANT to the Public Works Act 1928 and the Electric Power Boards Act 1925, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER

This order may be cited as the Amethyst Electric Power Board Electric Lines Licence 1964.

Subject to the conditions hereinafter set forth, the Amethyst Electric Power Board (hereinafter referred to as "the licensee") is hereby authorised to lay, construct, put up, place, and use electric lines within the area described in the Schedule hereto.

The conditions directed to be implied in all licences by the Electrical Supply Regulations 1935 and the Electrical Wiring Regulations 1961 shall be incorporated herein and shall form part of this licence, except in so far as they may be inconsistent with the provisions of this licence.

The licence hereby conferred is subject to compliance by the licensee with the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1961, the Radio Interference Regulations 1958, and with all regulations made in amendment thereof or in substitution therefor, except in so far as they may be inconsistent with the provisions of this licence.

The systems of supply shall be as described in paragraphs (a), (b), (c), (d), (e), and (f) of regulation 21-01 of the Electrical Supply Regulations 1935.

This licence shall, unless it is sooner lawfully determined, continue in force until the 31st day of March 1985.
SCHEDULE AREA OF SUPPLY
The Amethyst Electric Power District as defined in the Schedule to the Proclamation dated the 5th day of May 1964 and published in the Gazette on the 14th day of the same month at page 803.

Consenting to Raising of Loans by Certain Local Authorities

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL PURSUANT to the Local Authorities Loans Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto by way of loan of the whole or any part of the respective amounts specified in that Schedule.
