ADVERTISMENT OF PETITION

In the Supreme Court of New Zealand M. No. 259/64 Northern District (Auckland Registry)

In the matter of the Companies Act 1955 and in the matter of A. D. Service Ltd., notice is hereby given that a petition for an order that the company and/or the shareholders thereof, other than the petitioners, be ordered to purchase from the petitioners the shares in the capital of the company held by the petitioners and at a price to be fixed by arbitration in accordance with the Arbitration Act 1908, or alternatively that the allotment of shares of the company to New Zealand Electrical Traders Ltd. be declared invalid, or for such other order as shall be just was presented to the Supreme Court on the 26th day of June 1964 by Radio Repairs Ltd., Televier Distribution Ltd., Udy Electrical Ltd., Magness Sound Ltd., Magness Investments Ltd., R. J. Magness Ltd., and Webb's Radios Ltd., all duly incorporated companies having their respective registered offices at Auckland, and M. C. L. Rhodes, of Auckland, company director, and B. E. Grey and J. Scott, both of Auckland, appliance dealers; and that the said petition is directed to be heard before the Court sitting at Auckland on the 31st day of July 1964, at 10 a.m., and any creditor or contributory of the said company desirous to support or oppose the making of an order on the said petition may appear at the time of hearing in person or by his Counsel for that purpose; and a copy of the petition will be furnished by the undersigned to any creditor as contributory of the said company requiring a copy on payment of the regular charge for the same.

The notice must state the name, address, and description of the person, or, if a firm, the name, address, and description of the firm, and an address for service within 3 miles of the office of the Supreme Court at Auckland, and must be signed by the person or firm, or his or their Solicitor, and must be served, or, if posted, must be sent by post in sufficient time to reach the above-named petitioners' address for service not later than 4 p.m. on Thursday, 30 July 1964.

MOUNT ROSKILL BOROUGH COUNCIL

RESOLUTION MAKING SPECIAL RATE

Roads and Streets Amalgamated Renewal Loan 1964, £61,000

PURSUANT to the Local Authorities Loans Act 1956, the Mount Roskill Borough Council hereby resolves as follows:

“That, for the purpose of providing annual charges on a loan of sixty-one thousand pounds (£61,000) authorised to be raised by the Mount Roskill Borough Council under the above-mentioned Act for repayment of £61,000 borrowed for road reconstruction purposes, due and payable on the 1st day of August 1964, the said Mount Roskill Borough Council hereby makes a special rate of decimal one seven five pence (0.175d.) in the pound (£) upon the rateable value, on the basis of unimproved value, of all rateable property in the Borough of Mount Roskill; and that the said special rate shall be an annually recurring rate during the currency of the said loan, and to be payable yearly on the 1st day of April in each and every year during the currency of the said loan, being for a period of ten (10) years, or until the loan is fully paid off.”

Passed at a meeting of the Council held on the 7th day of July 1964.

HAMILTON CITY COUNCIL

RESOLUTION MAKING SPECIAL RATE

Streets Renewal Loan 1964, £42,000

PURSUANT to the Local Authorities Loans Act 1956, the Hamilton City Council hereby resolves as follows:

“That, for the purpose of providing the annual charges on a loan of forty-two thousand pounds (£42,000) authorised to be raised by the Hamilton City Council under the above-mentioned Act for the purpose of repaying on maturity that portion of the Streets Loan 1951, £198,400, which matures on 1 September 1964, the said Hamilton City Council hereby makes a special rate of six hundred and eighty-nine ten-thousandths of a penny (0.0689d.) in the pound upon the rateable value of all rateable property in the City of Hamilton;

and that the special rate shall be an annual-recurring rate during the currency of the loan, and be payable yearly on the 1st day of April of each and every year during the currency of the loan, being a period of ten (10) years, or until the loan is fully paid off.”

I hereby certify that the above is a true and correct copy of a resolution passed at a duly constituted meeting of the Hamilton City Council held on the 23rd day of June 1964.

HAMILTON CITY COUNCIL

RESOLUTION MAKING SPECIAL RATE

Stormwater and Streets Renewal Loan 1964, £24,700

PURSUANT to the Local Authorities Loans Act 1956, the Hamilton City Council hereby resolves as follows:

“That, for the purpose of providing the annual charges on a loan of twenty-four thousand seven hundred pounds (£24,700) authorised to be raised by the Hamilton City Council under the above-mentioned Act, for the purpose of repaying on maturity that portion of the principal owing under the Storm-water Drainage Loan 1951, £28,000, which matures on 1 September 1964, and those portions of the Stormwater Drainage and Ulster Street Culvert Loan 1956, £100,000, and the Streets Loan 1955, £200,000, which mature on 20 August 1964, the said Hamilton City Council hereby makes a special rate of three hundred and three ten-thousandths of a penny (0.0303d.) in the pound upon the rateable value of all rateable property in the City of Hamilton; and that the special rate shall be an annual-recurring rate during the currency of the loan, and be payable yearly on the 1st day of April of each and every year during the currency of the loan, being a period of fifteen (15) years, or until the loan is fully paid off.”

PURSUANT to the Local Authorities Loans Act 1956, the Hamilton City Council hereby resolves as follows:

“That, for the purpose of providing the annual charges on a loan of twenty-seven thousand eight hundred pounds (£27,800) authorised to be raised by the Hamilton City Council under the above-mentioned Act for the purpose of repaying on maturity that portion of the Fairfield and Enderley Sewer and Water Loan 1951, £85,000, which matures on 1 September 1964, the said Hamilton City Council hereby makes a special rate of three hundred and forty-one ten-thousandths of a penny (0.0341d.) in the pound upon the rateable value of all rateable property in the City of Hamilton; and that the special rate shall be an annual-recurring rate during the currency of the loan, and be payable yearly on the 1st day of April of each and every year during the currency of the loan, being a period of fifteen (15) years, or until the loan is fully paid off.”

“That, for the purpose of providing the annual charges on a loan of forty thousand pounds (£40,000) authorised to be raised by the Hamilton City Council under the above-mentioned Act for the purpose of repaying on maturity those portions of the Beerescount Sewer Loan 1953, £101,000 Hillcrest Sewer Loan 1950, £15,400, and the Melville Lake Crescent Sewer Loan 1950, £12,600, which mature on 1 September 1964, the said Hamilton City Council hereby makes a special rate of four hundred and ninety-one ten-thousands of a penny (0.0491d.) in the pound upon the rateable value of all rateable property in the City of Hamilton; and that the special rate shall be an annual-recurring rate during the currency of the loan, and be payable yearly on the 1st day of April of each and every year during the currency of the loan, being a period of fifteen (15) years, or until the loan is fully paid off.”
