ADVERTISMENT OF PETITION

In the Supreme Court of New Zealand No. M. 95/64 Wellington District
(Wellington Registry)

In the matter of the Companies Act 1955 and in the matter of S. Cole and Co. Ltd., notice is hereby given that a petition for the winding up of the above-named company by the Supreme Court was, on the 4th day of May 1964, presented to the said Court by the Commissioner of Inland Revenue, and that the said petition is directed to be heard before the Court sitting at Wellington on the 10th day of June 1964 at 10 a.m.; and any creditor or contributory of the said company desirous to support or oppose the making of an order on the said petition may appear at the time of hearing in person or by his counsel for that purpose; and a copy of the petition will be furnished by the undersigned to any creditor or contributory of the said company requiring a copy on payment of the regulated charge for the same.

DECLARATION

In conformity with the above Act, I, Ernest Bissett, General Manager of The Guardian Trust and Executors Co. of New Zealand Ltd., do solemnly and sincerely declare:

  1. That the liability of the members is limited. The capital of the company is £100,000, fully paid, divided into 20,000 shares of £5 each.

The assets of the company in its corporate capacity on the 31st day of December last were £225,591.

The liabilities of the company in its corporate capacity on that day were £10,275.

The first annual licence was issued on the 10th day of March 1911.

  1. That, in the capacity of Trustees and Executors, the amount of moneys received on account of estates up to the 31st day of December last was £120,134,836.

The amount of moneys paid on account of estates up to that day was £119,820,007.

The amount of balances held in trust accounts at various banks on account of Estates under administration on that day was £314,829.

  1. And I make this solemn declaration conscientiously believing the same to be true and by virtue of the provisions of an Act of the General Assembly of New Zealand intituled the Oaths and Declarations Act 1957.

OPOTIKI BOROUGH COUNCIL

RESOLUTION MAKING SPECIAL RATE

Sewerage Loan 1952, £15,800

PURSUANT to the Local Authorities Loans Act 1956, the Opotiki Borough Council hereby resolves as follows:

"That, for the purpose of providing the annual charges on a loan of £15,800 authorised to be raised by the Opotiki Borough Council under the above-mentioned Act for the purpose of repaying on maturity that portion of the Sewerage Loan 1952 which matures on the 15th day of July 1964, the said Opotiki Borough Council hereby makes a special rate of decimal point seven five pence (0·75d.) in the pound (£) upon the rateable value of all rateable property of the Borough of Opotiki; and that the special rate shall be an annually recurring rate during the currency of the loan and be payable yearly on the 1st day of April in each and every year during the currency of the loan, being a period of 25 years, or until the loan is fully paid off."

WELLINGTON CITY COUNCIL

RESOLUTION MAKING SPECIAL RATE

Regent Street Pensioners' Flats Loan, £47,500

The following resolution was duly passed at a meeting of the Wellington City Council held on the 13th day of May 1964. Pursuant to the Local Authorities Loans Act 1956, the Wellington City Council hereby resolves as follows:

"That, for the purpose of providing the annual charges on a loan of forty-seven thousand five hundred pounds (£47,500) to be known as the Wellington City Regent Street Pensioners' Flats Loan 1964 of £47,500 authorised to be raised by the Wellington City Council under the above-mentioned Act for the purpose of erecting accommodation for old people, the Wellington City Council hereby makes a special rate of thirteen one-thousandths of a penny (0·013d.) in the pound on the rateable value (on the basis of the unimproved value) of all rateable property within the whole of the City of Wellington; and that the said special rate shall be an annual-recurring rate during the currency of such loan and shall be payable yearly on the 1st day of April in each year during the currency of the said loan, being a period of thirty-five (35) years, or until the loan is fully paid off."

WAIIHEMO COUNTY COUNCIL

RESOLUTION MAKING SPECIAL RATE

Office Extension Loan No. 1, 1964

IN pursuance and exercise of the powers vested in it in that behalf by the Local Authorities Loans Act 1956, the Waihemo County Council hereby resolves as follows:

"That, for the purpose of providing the annual charges on a loan of £13,500 authorised to be raised by the Waihemo County Council under the above-mentioned Act for altering and extending the county office building and providing furnishings, the said Waihemo County Council hereby makes a special rate of 0·17199 pence in the pound (£) upon the rateable value (based on the unimproved value) of all rateable property of the whole of the County of Waihemo; and that the special rate shall be an annual-recurring rate during the currency of the loan and payable yearly on the 1st day of August in each and every year during the currency of the loan, being a period of thirty (30) years, or until the loan is fully paid off."

I hereby certify that the above-mentioned resolution is a true and correct copy of the resolution passed by the Waihemo County Council at a meeting held on the 18th day of May 1964.

GOLDEN BAY COUNTY COUNCIL

RESOLUTION MAKING SPECIAL RATE

Rural Housing Loan 1964, £10,000

PURSUANT to the Local Authorities Loans Act 1956, the Golden Bay County Council hereby resolves as follows:

"That, for the purpose of providing the annual charges on a loan of £10,000 authorised to be raised by the Golden Bay County Council under the above-mentioned Act for the purpose of making advances under the Rural Housing Act 1939, the said Golden Bay County Council hereby makes a special rate of fifteen sixty-fourths of one penny (15/64 of 1d.) in the pound upon the rateable value (on the basis of unimproved value) of all rateable property of the County of Golden Bay; and that the special rate shall be an annual-recurring rate during the currency of the loan and be payable yearly on the 1st day of April in each and every year during the currency of the loan, being a period of 20 years, or until the loan is fully paid off."

I hereby certify that the above resolution was passed at a meeting of the Golden Bay County Council held on the 12th day of May 1964.
