SCHEDULE
ALL that area in the Hawke’s Bay Land District containing approximately 100,000 acres, comprising the Weber Riding in Dannevirke County and part of the Porangahau Riding in Patangata County, bounded by a line commencing at the sea coast in the middle of the Waimata Stream, in Block XIII, Tautane Survey District, and proceeding up the middle of that stream to a point in line with the western boundary of Section 1, Block XIII, aforesaid; thence northerly to and along that boundary to the westernmost corner of the said Section 1, being also Trig. Station Taumatao te atua (39A); thence north-westerly generally along right lines from that trig. station through Trig. Stations Otuarehua, Mount Arthur, and Pukehou to Wahatuara, being the south-eastern corner of Puketoi 6A Block; thence north-easterly generally along the south-eastern boundaries of Puketoi 6A and 6B Blocks to the north-eastern corner of the last-mentioned block (Trig. Station Oporae) and easterly along the southern boundaries of Sections 2, 3, and 4, Block XIII, Mangatoro Survey District, Lots 2 and 3, D.P. 6539, the abutment of a public road, Sections 4 and 6, Block XIV, aforesaid, including the crossing of Weber and Speedy Roads, and Sections 3 and 1, Block XV, aforesaid, including the crossing of a public road, to the western boundary of Lot 2, D.P. 6640; thence northerly along that boundary and easterly generally along the northern boundaries of that Lot 2 and Lot 1, D.P. 6640, to and southerly along the eastern boundary of the last-mentioned Lot 1, to a point due west of a point on the north-western boundary of Section 1, Block XVI, Mangatoro Survey District, 1700 links from the northernmost point of that section; thence due east along a right line to and north-easterly along the aforesaid boundary to that northernmost point; thence southerly generally along the eastern boundaries of that Section 1 and Lots 1 and 2, D.P. 2910, to and south-easterly along the north-eastern boundaries of Lots 1 and 2, D.P. 7290, and Sections 2, 3, and 4, Block I, Tautane Survey District, to and southerly along the eastern boundary of the said Section 4 and its production to the southern side of Birch Road; thence easterly generally along that roadside across and along No. 52 State Highway to and along the southern and western sides of public roads through Blocks II, III, and VII, Tautane Survey District, to a point in line with the northern boundary of Lot 9, D.P. 1215; thence easterly to and along that boundary and the northern boundary of Lot 11, D.P. 1215, to the sea coast (at Arataura); thence southerly and westerly generally along the sea coast to the point of commencement.

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby (a) declares the piece of road described in the Schedule hereto to be a Government road and (b) stops the said road.

PURSUANT to section 11 of the Housing Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the access way described in the Schedule hereto shall, on and after the date of this Order in Council, vest in the Mayor, Councillors, and Citizens of the City of Rotorua and be under the control and management of the Rotorua City Council.

Authorising Roger Maxwell McKinnon, of Taihape, Farmer, to Use Water for the Purpose of Generating Electricity

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to Roger Maxwell McKinnon, of Taihape, farmer (hereinafter referred to as the licensee), a licence, subject to the conditions hereinafter set forth, to take and use from an unnamed stream (hereinafter referred to as the said stream), situated in Murimutu, Section 13, Block 2B, Moawhanga Survey District, in the County of Waimarino, for the purpose hereinafter set forth, a stream of water not exceeding 100 cu. ft. per second at any one time.
CONDITIONS
IMPLIED CONDITIONS
- The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.
LICENCE SUBJECT TO REGULATIONS
- This licence is issued under the Water Power Regulations 1934 and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1961, the Radio Interference Regulations 1958, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.
UTILISATION OF WATER AND LOCATION OF HEAD WORKS
- Water shall be used under this licence solely for the purpose of generating electricity and shall be taken from the said stream at the point in Murimutu, Section 13, Block 2B, Moawhanga Survey District, as indicated on the plan marked N.Z.E.D. 617 deposited in the office of the New Zealand Electricity Department at Wellington.
GENERAL DESCRIPTION OF WORKS
- The licensee is hereby authorised, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being indicated on the said plan N.Z.E.D. 617:
(a) Head works consisting of a dam and intake with a pipeline leading to the powerhouse hereinafter referred to, giving a static head of approximately 15 ft.
(b) Turbine and powerhouse with all necessary equipment for generating electricity, situated in Murimutu, Section 13, Block 2B, Moawhanga Survey District.
(c) Tail race leading from the said powerhouse back to the said stream.
SYSTEM OF SUPPLY
- The system of supply shall be as described in paragraph (d) of regulation 21–01 of the Electrical Supply Regulations 1935.
DURATION OF LICENCE
- Unless sooner lawfully determined, this licence shall continue in force until the 31st day of March 1984.
RENTAL
- For the purpose of assessing the rental or annual sum payable in respect of this licence, the present plant is rated at 10 kW.
NO RIGHT TO WATER CONFERRED
- Nothing in this licence shall of itself confer upon the licensee any right to water.
