Order No. 4 (1963) of the Trade Practices and Prices Commission
In the matter of the Trade Practices Act 1958 and in the matter of an inquiry concerning certain recommendations as to the retail margins on toys made by the New Zealand Retailers' Federation, the New Zealand Cycle Traders' Federation, the Associated Booksellers of New Zealand, and the New Zealand Commercial Stationers' Guild.
WHEREAS pursuant to section 17 of the Trade Practices Act 1958, the Examiner of Trade Practices and Prices on the 3rd day of December 1962 presented to the Trade Practices and Prices Commission a report on certain recommendations as to the retail margins on toys contained in a circular bearing date the 10th day of July 1962 and issued by the New Zealand Retailers' Federation, the New Zealand Cycle Traders' Association, and the Associated Booksellers of New Zealand, to all toy stockists and in a further circular bearing date the 26th day of July 1962 and issued by the said Federation, the said Association, and the said Associated Booksellers, and the New Zealand Commercial Stationers' Guild (hereinafter referred to as the said trade associations) to all toy stockists.
And whereas by virtue of subsection 8 of section 19 of the said Act the said recommendations constitute an agreement to which all toy stockist members of the said trade associations are deemed to be parties.
And whereas the Trade Practices and Prices Commission is required by section 18 of the said Act to conduct an inquiry into the said agreement.
And whereas the Commission has heard Mr Orr of counsel for the Examiner and Mr Blundell of counsel for the said trade associations.
And whereas Mr Blundell on behalf of the said trade associations has admitted that the said agreement is a trade practice in terms of section 19 (2) (c) of the said Act, and further that the said trade associations, whilst not accepting necessarily the opinions of the said Examiner as to the application in the circumstances of any particular paragraph in section 20 of the said Act, do accept that the said agreement is or would if implemented be contrary to the public interest and accordingly consent to the making of an order pursuant to section 19 (1) of the said Act.
And whereas the Commission has decided that an order should be made under the said Act in respect of the said trade practice.
Now therefore the Trade Practices and Prices Commission hereby orders and directs—
(i) The New Zealand Retailers’ Federation, the New Zealand Cycle Traders’ Federation, the Associated Booksellers of New Zealand, and the Commercial Stationers’ Guild respectively, and the members of each of those trade associations, to discontinue and to refrain from reviving in any form the practice of recommending retail margins and selling prices of toys.
(ii) The New Zealand Retailers’ Federation, the New Zealand Cycle Traders’ Federation, the Associated Booksellers of New Zealand, and the Commercial Stationers’ Guild:
(a) Where applicable to pass within 28 days of the coming into force of this order a resolution rescinding the decisions reached in regard to increased margins and prices of toys as promulgated to toy stockists by the said circulars respectively bearing dates the 10th and 26th days of July 1962.
(b) To furnish the Examiner of Trade Practices and Prices with copies of these resolutions as soon as practicable after they have been passed.
(iii) The New Zealand Retailers’ Federation, in its name and in the name of the New Zealand Cycle Traders’ Federation, the Associated Booksellers of New Zealand, and the New Zealand Commercial Stationers’ Guild:
(a) Within 30 days of the coming into force of this order to advise in writing all those toy stockists to whom the said circulars were sent that the said circulars, the recommendations contained therein, and the price lists dispatched therewith have been cancelled, and that henceforth the said trade associations will not engage in any further pricing on behalf of toy stockists in respect of toys, and that it will accordingly be the personal responsibility of each toy stockist to compute his retail selling prices in accordance with the trading circumstances of his own particular business without consultation with his competitors.
(b) Within 30 days of the coming into force of this order to advise in writing all leading manufacturers of toys in New Zealand that the circular bearing date the 23rd day of July 1962, a copy of which is annexed to the said report of the said Examiner and the representations contained therein are cancelled.
(c) To furnish to the Examiner of Trade Practices and Prices copies of the written advices to toy stockists and to manufacturers of toys referred to in the preceding paragraphs (a) and (b) as soon as practicable after they have been dispatched.
(iv) The New Zealand Retailers’ Federation and the New Zealand Commercial Stationers’ Guild to publish in the next issue of their respective magazines or journals a statement similar to that sent to toy stockists in terms of paragraph (iii) (a) hereof and to furnish copies of these statements to the Examiner of Trade Practices and Prices as soon as practicable after publication.
