SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

All that portion of Palmer Road situated in Block X, Tatua Survey District, commencing at the Tirau-Wairakei State Highway on the north-western boundary of Section 15 of the aforesaid Block X, and proceeding thence in an easterly direction generally for a distance of approximately 2 miles 30 chains and terminating at the north-eastern corner of Section 18 of the aforesaid Block X.

As the same is more particularly delineated on the plan marked M.O.W. 7066 (S.O. 39880) deposited in the office of the Minister of Works at Wellington, and thereon coloured red and marked A-B.

Pursuant to section 11 of the Housing Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the access ways described in the Schedule hereto shall, on and after the date of this Order in Council, vest in the Mayor, Councillors, and Citizens of the City of Auckland and be under the control and management of the Auckland City Council.

Boundaries of the County of Cook and the City of Gisborne Altered

THE HON. J. R. MARSHALL, PRESIDING IN COUNCIL

Pursuant to the Local Government Commission Act 1961, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. That on and from the 1st day of April 1963 the area described in the Schedule hereto is hereby excluded from the County of Cook and included in the City of Gisborne.

  2. That the alteration of the boundaries of the said county and the said city hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.

SCHEDULE

All that area in the Gisborne Land District, County of Cook, containing 319 acres 2 roods, more or less, bounded by a line commencing at the north-eastern corner of Lot 2, D.P. 4008, on the left bank of the Waimata River in Block III, Turanganui Survey District, being a point on the boundary of the City of Gisborne as described in Gazette 1956, pages 409 and 410, and proceeding north-easterly along the said left bank to the northernmost corner of Lot 5, D.P. 4848; thence south-easterly generally along the north-eastern boundaries of Lots 5 and 4, D.P. 4848, Lots 6, 4, and 3, D.P. 4547, and Lot 2, D.P. 4353, to a point in line with the south-eastern side of Gaddum's Hill Road, to and along that side and the south-western and south-eastern sides of Gaddum's Hill Road to the westernmost corner of Lot 18, D.P. 4425, along the south-western boundaries of Lots 18 and 19, D.P. 4425, and the production of the last-mentioned boundary across Tyndall Road to the westernmost corner of the land shown on D.P. 1607, along the south-western boundary of the said land and its production to the northern boundary of Section 3, Block VII, Turanganui Survey District, along the said northern boundary to the north-western side of Lyell Road; thence

north-easterly along the north-western side of Lyell Road to its junction with Herschell Road; thence south-easterly, bearing 154° 25', distance 110·6 links (D.P. 484), to a road angle, being the junction of the south-eastern sides of Lyell and Herschell Roads; thence southerly generally along a right line to the northernmost corner of Lot 1, L.T. Plan 1059, along the eastern boundaries of Lots 1 and 2, L.T. Plan 1059, the northern and eastern boundaries of Alfred Street, the eastern boundary of Lot 7, L.T. Plan 1059, the southern boundaries of Lot 7 aforesaid and of Lot 6, L.T. Plan 1059, to a point in line with the eastern boundary of Lot 2, D.P. 4162, and along that boundary, along a right line to the north-eastern corner of Lot 1, D.P. 4533, along the eastern and southern boundaries of the said Lot 1 and the production of the last-mentioned boundary to the eastern boundary of part Kaiti 295 Block, along the eastern boundary of the said block to its south-eastern corner, along a right line to intersect, on the southern boundary of Lot 9, D.P. 927, a right line parallel to and 250 links distant from the eastern side of Paraone Road, along the last-mentioned right line to the north-eastern corner of Lot 2, D.P. 2705, along the eastern boundaries of Lots 2, 3, and 4, D.P. 2705, the southern boundary of said Lot 4 and its production across Paraone Road to its western side, along a right line to and along the south-eastern boundary of part Lot 23, D.P. 927, and its production to a point in the middle of Wainui Road, 62·5 links from the south-western side; thence northerly generally along a line parallel to the said south-western side of Wainui Road to a point in line with the middle of Tyndall Road, to and along that line and the middle line of Owen Road and its production to the point of commencement.

Boundaries of County of Selwyn and County of Ellesmere Altered, and the Union of Selwyn and Malvern Counties

THE HON. J. R. MARSHALL PRESIDING IN COUNCIL

Pursuant to the Local Government Commission Act 1961, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. (a) That on and from the 31st day of March 1963 the area described in the First Schedule hereto is hereby excluded from the County of Selwyn and included in the County of Ellesmere, and shall form an additional riding of that county by the name of the Rakaia Riding.

(b) That the Rakaia Riding of the County of Ellesmere shall be represented on the Council of that county by two members and for that purpose the number of members of that Council shall be increased from eight to 10.

(c) That the first election of the two members to represent the Rakaia Riding on the Council of the County of Ellesmere shall be held on the day fixed by law for the next triennial general elections of members of county councils.

(d) That until the members elected as aforesaid come into office, two members of the present Council of the County of Selwyn, to be chosen by that Council, shall represent the Rakaia Riding on the Council of the County of Ellesmere.

  1. (a) That on and from the 1st day of April 1963 the County of Selwyn, as described in the Second Schedule hereto, and the County of Malvern are hereby united to form one county to be known as the County of Malvern, hereinafter referred to as the united county.

(b) That the united county shall be divided into four ridings to be known as the Selwyn, Courtenay, Sheffield, and Homebush Ridings.

(c) That the Selwyn Riding of the united county shall comprise the area described in the Second Schedule hereto and the Courtenay, Sheffield, and Homebush Ridings of the united county shall comprise respectively the present Courtenay, Sheffield, and Homebush Ridings of the present County of Malvern.

(d) That the number of members of the Council of the united county shall be 11 to be elected as follows:

For the Selwyn Riding ... 3 members
For the Courtenay Riding ... 5 members
For the Sheffield Riding ... 2 members
For the Homebush Riding ... 1 member

(e) That the first election of members of the Council of the united county shall be held on the day fixed by law for the next triennial general elections of members of county councils.

(f) That until the members elected as aforesaid come into office, the Council of the united county shall comprise the eight members of the present Council of the County of Malvern and three members of the present Council of the County of Selwyn to be chosen by that Council.

  1. That the alteration of boundaries and the union of the aforesaid counties hereinbefore made shall be deemed to have been effected under the Counties Act 1956.
