Reservation of Land and Declaration that Land be Part of Lake Okareka Scenic Reserve

PURSUANT to the Land Act 1948, the Minister of Lands hereby sets apart the land described in the Schedule hereto as a reserve for scenic purposes and, further, pursuant to the Reserves and Domains Act 1953, declares the said reserve to form part of the Lake Okareka Scenic Reserve, to be administered as a scenic reserve by the Rotorua County Council.

Licensing the North Shore Golf Club (Inc.) to Use and Occupy a Part of the Foreshore and Bed of Lucas Creek, Waitemata Harbour, as a Site for a Wharf

PURSUANT to the Harbours Act 1950, the Minister of Marine hereby licenses and permits the North Shore Golf Club (Inc.) (hereinafter called the licensee, which term shall include its successors or assigns unless the context requires a different construction) to use and occupy a part of the foreshore and bed of Lucas Creek, Waitemata Harbour, as shown on plan marked M.D. 5156 and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon a wharf as shown on the said plan, such licence to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE

CONDITIONS

1. This licence is subject to the Foreshore Licence Regulations 1960, and the provisions of those regulations shall, so far as applicable, apply hereto.
2. The term of the licence shall be 14 years from the 1st day of September 1962.
3. The premium payable by the licensee shall be two pounds (£2) and the annual sum so payable shall be three pounds (£3).

Declaring Area to be an Access Lane for the Purposes of the Motor Launch Regulations 1962

PURSUANT to the Motor Launch Regulations 1962, the Minister of Marine hereby declares that for a period of five years from the date hereof, subject to compliance with the conditions set out in the First Schedule hereto, the area of water described in the Second Schedule hereto shall be an access lane and that within such access lane regulations 11 and 12 of the Motor Launch Regulations 1962 shall not apply.

FIRST SCHEDULE

THE access lane shall be marked as follows:

1. Brightly painted marker buoys each 50 yards apart commencing 50 yards from the edge of the lake at normal lake level shall be suitably moored along each side of the access lane.
2. At the edge of the lake at normal lake level at each side of the access lane in line with the marker buoys there shall be placed a notice board measuring not less than 2 ft 6 in. by 2 ft painted white with black letters.
3. The aforesaid notice board shall contain the following notice:

“NOTICE

Motor Launch Regulations 1962

Access lane through which motor launches and water skiers may pass at speeds greater than 5 miles per hour. When leaving or entering the lane the port of left hand side is to be used.

Bathers Keep Out.”

SECOND SCHEDULE

ALL that area of water immediately in front of the terraced car park at the north-western corner of Lake Tikiterpu bounded on the sides by parallel lines extending in a 168° true direction 200 yards from the edge of the water, the eastern boundary being in line with the eastern corner of the Rotorua County boundary reserve and the western boundary commencing at a point on the lake edge on a bearing of 215° true from where the eastern boundary abuts the shore.
