Authorising John James Morris, Hotel Proprietor, Maruia Hot Springs, to Use Water for the Purpose of Generating Electricity and Revoking a Previous Licence

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to John James Morris, of Maruia Hot Springs, hotel proprietor (hereinafter referred to as the licensee), a licence subject to the conditions hereinafter set forth, to take and use from Waterfall Creek (hereinafter referred to as the said stream), situated in part Section 2, Square 182, Block I, Travers Survey District, in the Land District of Nelson, for the purpose hereinafter set forth, a stream of water not exceeding 10 cubic feet per second at any one time and, further, hereby revokes the Order in Council dated the 20th day of September 1950 and published in the Gazette on the 21st day of September 1950, at page 1760, authorising Sarah Theresa Morris, of Maruia Hot Springs, Chateau proprietress, to use water for the purpose of generating electricity and to erect certain electric lines.

CONDITIONS
IMPLIED CONDITIONS
- The conditions directed to be implied in all licences by the Electrical Supply Regulations 1935 and the Electrical Wiring Regulations 1961 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provision hereof.
LICENCE SUBJECT TO REGULATIONS
- The licence hereby conferred is subject to compliance by the licensee with the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1961, the Radio Interference Regulations 1958, and with all regulations hereafter made in amendment thereof or in substitution thereof respectively.
UTILISATION OF WATER AND LOCATION OF HEADWORKS
- Water shall be used under this licence solely for the purpose of generating electricity, and shall be taken from the said stream at the point in part Section 2, Square 182, Block I, Travers Survey District, as indicated on the plan marked N.Z.E.D. 592 deposited in the office of the New Zealand Electricity Department at Wellington.
GENERAL DESCRIPTION OF WORKS
- The licensee is hereby authorised, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being more particularly shown on the said plan N.Z.E.D. 592.
(a) Headworks consisting of an intake, with a water race, penstock, and pipe line leading to the Pelton wheel and powerhouse hereinafter referred to, giving a static head of approximately 400 ft.
(b) Pelton wheel and powerhouse with all necessary equipment for generating electricity, situated in part Section 2, Square 182, Block I, Travers Survey District.
(c) Tail-race leading from the said powerhouse to the Maruia River.
SYSTEM OF SUPPLY
- The system of supply shall be as described in paragraphs (a) and (d) of regulation 21–01 of the Electrical Supply Regulations 1935, and shall be an alternating-current system.
DURATION OF LICENCE
- Unless sooner lawfully determined this licence shall continue in force until the 31st day of March 1983.
RENTAL
- For the purpose of assessing the rental or annual sum payable in respect of this licence the maximum generating capacity of the plant at the commencement of this licence is 25 kW.
NO RIGHT TO WATER CONFERRED
- Nothing in this licence shall of itself confer upon the licensee any right to water.

PURSUANT to the Local Authorities Loans Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto by way of loan of the whole or any part of the respective amounts specified in that Schedule.

The area described in the Schedule hereto is hereby excluded from the Borough of Ellerslie and included in the Borough of Mount Wellington.

The alteration of the boundaries of the said boroughs hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.

SCHEDULE
ALL that area in the North Auckland Land District, Borough of Ellerslie, bounded by a line commencing at the southernmost corner of Section 211, Prescott Settlement, in Block I, Otahuhu Survey District, and proceeding southerly and westerly along the eastern and southern boundaries of Section 171, Prescott Settlement, to a point in line with the south-eastern boundary of Section 211 aforesaid; thence along a right line to the point of commencement.
