Street in the Borough of Masterton Imposed by Resolution
Under Section 128 of the Public Works Act 1928

At the Government Buildings at Wellington this 2nd day of
April 1962
Present:
THE RIGHT HON. KEITH HOLYOAKE PRESIDING IN COUNCIL
Pursuant to section 131 of the Public Works Act 1928, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby amends
the resolutions passed by the Masterton Borough Council,
deposited in the Land Registry Office at Wellington as
K. 39212 and K. 38845, declaring that section 128 of the
Public Works Act 1928 shall not apply to the south-east
and east sides of portions of Chapel Street respectively,
subject to building-line conditions, by cancelling the said
building-line conditions imposed by the said resolutions.

Authorising the Laying Off of an Extension of Summertime
Avenue in the City of Dunedin at a Width of Less than
66 ft but Not Less Than 44 ft, Subject to a Condition as to
the Building Line

THE RIGHT HON. KEITH HOLYOAKE PRESIDING IN COUNCIL
Pursuant to section 186 of the Municipal Corporations Act
1954 and section 125 of the Public Works Act 1928, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby authorises
the Dunedin City Council to permit the laying off of the
proposed new street described in the Schedule hereto at a width
of less than 66 ft, but not less than 44 ft, subject to the
condition that no building or part of a building shall at any
time be erected on the land shown edged green on the plan
marked M.O.W. 4771 referred to in the said Schedule within
a distance of 15 ft from the side lines of the said new street.
SCHEDULE
Otago Land District
That proposed street in the City of Dunedin containing 1 rood
18 perches, more or less, situated in Ocean Beach Survey
District, being part Lot 3, D.P. 9091, being part Sections 17
and 18; as the same is more particularly delineated on the
plan marked M.O.W. 4771 deposited in the office of the
Minister of Works at Wellington, and thereon coloured red.

Pursuant to section 186 of the Municipal Corporations Act
1954 and section 125 of the Public Works Act 1928, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby authorises
the Taumarunui Borough Council to permit the laying off
of the proposed street described in the Schedule hereto at a
width for part of its length of less than 66ft, but not less
than 40 ft, subject to the condition that no building or part
of a building shall at any time be erected on Lots 5 to 15
(inclusive), 19, 20, 21, 22, 23, and 28 of a subdivision of
the land shown edged green on the plan marked M.O.W.
5004 referred to in the said Schedule within a distance of
15 ft from the side line of the said street.

That proposed street in the Borough of Taumarunui containing
by admeasurement 1 rood 19·8 perches, more or less,
being part Ohura South N2 E3 G2E and N2 E3 G2c Blocks,
Block II, Piopiotea West Survey District; as the same is more
particularly delineated on the plan marked M.O.W. 5004
deposited in the office of the Minister of Works at Wellington,
and thereon coloured red.

1954 and section 125 of the Public Works Act 1928, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby authorises
the Birkenhead Borough Council to permit the laying off of the
proposed street described in the Schedule hereto at a width of
less than 66 ft, but not less than 40 ft, subject to the condition
that no building or part of a building shall at any time be
erected on a subdivision of the land shown edged green on the
plan marked M.O.W. 4766 referred to in the said Schedule
within a distance of 15 ft from the sideline of the said street.

That proposed street in the Borough of Birkenhead containing
by admeasurement 1 rood 13·4 perches being part of the land
on D.P. 317 and being part Allotment 121, Parish of Takapuna.

Pursuant to section 11 of the Housing Act 1955, His Excel-
lency the Governor-General, acting by and with the advice
and consent of the Executive Council, hereby orders and
declares that the access way described in the Schedule hereto
shall, on and after the date of this Order in Council, vest in
the Mayor, Councillors, and Citizens of the City of Dunedin
and be under the control and management of the Dunedin
City Council.
