Consenting to the Taking of an Easement Over Land in Block XIII, Waoku Survey District, for the Purposes of a Public School

At the Government Buildings at Wellington this 19th day of March 1962

Present:

THE RIGHT HON. KEITH HOLYOAKE PRESIDING IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the taking of an easement over the land described in the First Schedule hereto for the purposes of a public school, vesting in Her Majesty the Queen full and free right, liberty, licence, and authority in perpetuity to convey water along, under, or over the said land and for that purpose to lay, construct, place, reconstruct, cleanse, repair, and maintain a line of water pipes along, under, or over the said land and to construct, use, and maintain a pumphouse thereon, such easement to be held appurtenant to the land described in the Second Schedule hereto.

FIRST SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL that piece of land containing 4·5 perches situated in Block XIII, Waoku Survey District, Auckland R.D., and being part Waimamaku B 2F 2B Block; as the same is more particularly delineated on the plan marked M.O.W. 3486 (S.O. 42951) deposited in the office of the Minister of Works at Wellington, and thereon coloured yellow.

SECOND SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL those pieces of land situated in Block XIII, Waoku Survey District, Auckland R.D., described as follows:

Varying a Condition as to Setting Back the Building Line of Portion of Connor Place in the Borough of Ashburton Imposed by Special Order Under the Municipal Corporations Act 1954

THE RIGHT HON. KEITH HOLYOAKE PRESIDING IN COUNCIL

PURSUANT to section 131 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends Special Order No. 538371, Canterbury Land Registry, by varying the condition as to building line imposed thereby, so that no building or part of a building shall at any time be erected on Lot 2, D.P. 21364, being part Rural Section 5800, being all the land in certificate of title, Register 1B, folio 846, Canterbury Land Registry, within a distance of 35 ft from the centre line of Connor Place or within a distance of 48 ft of the centre line of the proposed future road known as Lot 10, D.P. 21364, being part Rural Section 5800, being all the land in certificate of title. Register A 1, folio 1169, Canterbury Land Registry.

Varying a Condition as to the Building Line of Portion of Arthur’s Crescent in the City of Takapuna

At the Government Buildings at Wellington this 19th day of March 1962

Present:

THE RIGHT HON. KEITH HOLYOAKE PRESIDING IN COUNCIL

PURSUANT to section 131 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 2nd day of May 1945, published in the Gazette, 1945, Volume II, at page 451, and registered in the Land Registry Office at Auckland under No. 11615, authorising the laying off of a street of a width less than 66 ft, but not less than 40 ft, subject to a condition as to the building line, by varying the condition as to the building line imposed by the said Order in Council in so far as it affects Lots 13 and 14, D.P. 34572, so that no building or part of a building shall at any time be erected on the said Lots 13 and 14, D.P. 34572, within a distance of 40 ft from the centre line of the said street.
