Authorising the Laying Off of a Street off Lairdvale Road in the Borough of Taumarunui, Subject to Conditions as to the Building Line

At the Government Buildings at Wellington this 5th day of March 1962

Present:

THE RIGHT HON. KEITH HOLYOAKE PRESIDING IN COUNCIL

PURSUANT to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Taumarunui Borough Council to permit the laying off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft, but not less than 40 ft, subject to the condition that no building or part of a building shall at any time be erected on Lots 1 to 7 and 11 to 20 (all inclusive) of a subdivision of the land shown edged green on the plan marked M.O.W. 4791 referred to in the said Schedule within a distance of 25 ft from the side line of the said street, or on Lots 10 and 22 of the said subdivision within a distance of 15 ft from the side line of the said street.

Declaring a Service Lane to be Vested in the Corporation of the Town District of Murupara and to be Under the Control and Management of the Murupara Town Council

PURSUANT to section 11 of the Housing Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the service lane described in the Schedule hereto shall, on and after the date of this Order in Council, vest in the Chairman, Councillors, and Citizens of the Town District of Murupara and be under the control and management of the Murupara Town Council.

Varying a Condition as to Setting Back the Building Line of Portions of Streets Known as Moorhouse Street and Wade Street in the City of Wellington, Imposed by Orders in Council Under the Public Works Act 1908, and Revoking Previous Order in Council

THE RIGHT HON. KEITH HOLYOAKE PRESIDING IN COUNCIL

PURSUANT to section 131 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby revokes the Order in Council dated the 6th day of November 1961 and published in Gazette, 16 November 1961, page 1768, varying a condition as to setting back the building line of portions of Wade Street and of Moorhouse Street, imposed by Order in Council under the Public Works Act 1908, and hereby amends the Order in Council dated the 22nd day of December 1911, published in Gazette, 11 January 1912, Volume I, page 23, and deposited in the Land Registry Office at Wellington as No. 651, and the Order in Council dated the 26th day of March 1917, published in Gazette, 29 March 1917, Volume I, page 1122, and deposited in the Land Registry Office at Wellington as No. 759, exempting, inter alia, portions of Wade Street and of Moorhouse Street from the provisions of section 117 of the Public Works Act 1928, subject to conditions as to the building lines by varying the conditions with regard to the building lines imposed by the said Orders in Council so that no building or part of a building shall at any time be erected on Lot 1, D.P. 22498, within a distance of 25ft from the centre lines of the said streets.

Declaring Portion of Road in Block IV, Tokaanu Survey District, Taupo County, to be County Road

PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become county road.


SCHEDULE
SOUTH AUCKLAND LAND DISTRICT

ALL that portion of road situated in Block IV, Tokaanu Survey District, Taupo County, commencing at the westernmost corner of Section 80, Town of Oruatau, and proceeding thence in an easterly direction for a distance of approximately 17 chains and terminating at the State Highway No. 1.

As the same is more particularly delineated on the plan marked M.O.W. 4802 (S.O. 41162) deposited in the office of the Minister of Works at Wellington, and thereon coloured red and marked A-B.
