Licensing the Kaikoura Boating Club (Inc.) to Use and Occupy Parts of the Foreshore and Bed of the Sea at Kaikoura as Sites for Two Slipways.

PURSUANT to the Harbours Act 1950, the Minister of Marine hereby licenses and permits the Kaikoura Boating Club (Inc.) (hereinafter called the licensee, which term shall include its successors or assigns, unless the context requires a different construction) to use and occupy parts of the foreshore and bed of the sea at Kaikoura, as shown on plans marked M.D. 11093 and deposited in the office of the Marine Department at Wellington, for the purpose of erecting and maintaining two slipways thereon, as shown on the said plans, such licence to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE

  1. This licence is subject to the Foreshore Licence Regulations 1960, and the provisions of those regulations shall, so far as applicable, apply hereto.
  2. The premium payable by the licensee shall be five pounds (£5) and the annual sum so payable three pounds (£3).
  3. The term of the licence shall be 14 years from the 1st day of November 1961.

Licensing McCallum Brothers Ltd., of Auckland, to Use and Occupy a Part of the Foreshore and Bed of Huruhuru Creek, Waitemata Harbour, as a Site for a Breastwork and Landing

PURSUANT to the Harbours Act 1950, the Minister of Marine hereby licenses and permits McCallum Brothers Ltd., of Auckland (hereinafter called the licensee, which term shall include its successors or assigns unless the context requires a different construction), to use and occupy a part of the foreshore and bed of the Huruhuru Creek, Waitemata Harbour, as shown on plan marked M.D. 11007 and deposited in the office of the Marine Department at Wellington, for the purpose of erecting and maintaining thereon a breastwork and landing as shown on the said plan, such licence to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the First Schedule hereto, and prescribes that the dues and rates set forth in the Second Schedule hereto shall be charged and taken by the licensee for the use of the said breastwork and landing.

FIRST SCHEDULE

CONDITIONS

  1. This licence is subject to the Foreshore Licence Regulations 1960, and the provisions of those regulations shall, so far as applicable, apply hereto.
  2. The term of the licence shall be 14 years from the 1st day of September 1961.
  3. The premium payable by the licensee shall be five pounds (£5), and the annual sum so payable shall be ten pounds (£10).
  4. The Master of every vessel discharging ballast at the said breastwork and landing shall have all such ballast taken away and deposited above high-water mark or at such place as may be approved by the Minister or any persons appointed by the Minister for that purpose.

SECOND SCHEDULE

DUES AND RATES

Wharfage

EVERY person who shall use the breastwork and landing for landing or shipping goods shall pay to the licensee dues in respect of the landing and shipping of such goods as follows, that is to say:
For all goods landed or shipped at weight or measurement, according to shipping usage—

Bricks – per hundred ..... 1 0
Manures, fertilisers, etc., per ton ..... 0 9
All other goods not specified—per ton or part of a ton ..... 1 4

Passenger Wharfage
