Agreement for Grant of Easement in Favour of Eric George Eves, of Trentham, Soldier, Over Railway Land in Block I, Rimutaka Survey District

WHEREAS, by an agreement dated the 16th day of October 1961 Eric George Eves, of Trentham, soldier, agreed to set over and transfer to Her Majesty the Queen an easement of right of way created by memorandum of transfer No. 510017, Wellington Registry, over portion of the land comprised in a plan deposited in the Land Registry Office at Wellington as No. 22613:

And whereas the said Eric George Eves is entitled to receive compensation for the transfer of the said easement of right of way:

And whereas the Minister of Railways has agreed to grant to the said Eric George Eves an easement of right of way over the railway land as described in the Schedule hereto, such easement being appurtenant to Lots 1 and 2, D.P. 22613, Wellington Registry, in full satisfaction of the compensation aforesaid:

And whereas the said Eric Eves has agreed to accept such grant of easement in full satisfaction of the said compensation:

Now, therefore, the Minister of Railways hereby gives notice, pursuant to section 97 of the Public Works Act 1928, that he assents to the agreement hereinbefore referred to.

SCHEDULE

ALL that parcel of land containing 2·63 perches, more or less, being portions of Sections 91 and 92, Hutt District, and being part Lot 3, D.P. 22613, as shown coloured yellow on the said plan.

Exemption Order Under the Motor Drivers Regulations 1940

———

PURSUANT to the Motor Drivers Regulations 1940, the Minister of Transport hereby orders and declares that the provisions of clause (1) of regulation 7 of the said regulations so far as they relate to the driving of heavy trade motors shall not apply to the person hereinafter mentioned, but in lieu thereof the following provision shall apply:

A motor driver’s licence issued under the Motor Drivers Regulations 1940 to the person described in column 1 of the Schedule hereunder may authorise him to drive a heavy trade motor in the course of his employment for the employer described in column 2 of the said Schedule, but shall not authorise him, while he is under the age of 18 years, to drive a heavy trade motor for any other purpose.

Varying a Notice Declaring Parts of a Tribal District to be Tribal Committee Areas Under the Maori Social and Economic Advancement Act 1945

———

PURSUANT to section 14 of the Maori Social and Economic Advancement Act 1945, the Minister of Maori Affairs hereby varies the notice dated 23 September 1960 and published in the Gazette of 6 October 1960, at page 1565, declaring parts of the Waitemata Tribal District to be tribal committee areas for the purposes of the said Act by excluding from the Schedule thereto the description of the City West Tribal Committee area and substituting thereto the description appearing in the First Schedule hereto; and, pursuant to the said section 14 of the Maori Social and Economic Advancement Act 1945, the area in the Second Schedule hereto, being part of the aforesaid Waitemata Tribal District, is hereby declared to be a tribal committee area for the purposes of the said Act and the name appearing at the head of the description of such area is hereby assigned to such area as the name by which such area shall be described and known.

FIRST SCHEDULE

CITY WEST TRIBAL COMMITTEE AREA

ALL that area in the City of Auckland in the North Auckland Land District bounded by a line commencing at a point in Block XVI, Waitemata Survey District, on the line of mean high water of the southern shores of the Waitemata Harbour, being the middle of Fanshawe Street and running generally easterly along those shores to the westernmost corner of Queens Wharf; thence southerly along a right line across Quay Street to and along the middle of Queen Street, along the middle of Karangahape Road, along the middle of Symonds Street, and along the middle of the New North Road to and north-westerly along the middle of Virginia Avenue, the middle of Manning Street, the middle of Newton Road, along the middle of Great North Road, the middle of the Bullock Track, along the middle of Old Mill Road, and the middle of Garnet Road to and northerly and then easterly along the line of mean high water of the southern shores of the Waitemata Harbour to the point of commencement, together with the islands of Browns, Motuihe, Motutapu, Pine, Rakino, Rangitoto, Waiheke, and other small adjacent islands.

SECOND SCHEDULE

NORTH SHORE TRIBAL COMMITTEE AREA

ALL that area in the North Auckland Land District in the Waitemata County and the Boroughs of East Coast Bays, Takapuna, Devonport, Northcote, and Birkenhead bounded by a line commencing at the south-western corner of Allotment S.W. 110, Puhoi Parish, in Block I, Waiwera Survey District, and running easterly along the northern boundary of the Waitemata County as described in Gazette, No. 50, of 11 July 1957, page 1294, to and generally southerly along the shores of the Hauraki Gulf, to and westerly along the line of mean high water of the Waitemata Harbour to a point in line with a right line between Trig. Station B in Block VI, Waitemata Survey District, and Trig. Station E in Block XIII, Waiwera Survey District; thence northerly along a right line to Trig. Station E aforesaid and along another right line to the point of commencement.

Declaring Land Acquired for a Government Work and Not Required for That Purpose to be Crown Land, Subject to Certain Rights

———

PURSUANT to section 35 of the Public Works Act 1928, the Minister of Works hereby declares the land described in the Schedule hereto to be deemed to have been Crown land for the purposes of the Land Act 1948 as from the 20th day of November 1961, subject to the agreement as to fencing contained in memorandum of transfer No. 646542, Auckland Land Registry, and to the building-line restriction contained in K. 70226, Auckland Land Registry.
