Declaring Land Taken for a Government Work and Not Required for That Purpose to be Crown Land, Subject as to Parts to a Building-line Restriction

Pursuant to section 35 of the Public Works Act 1928, the Minister of Works hereby declares the land described in the Schedule hereto to be deemed to have been Crown land for the purposes of the Land Act 1948 as from the 7th day of September 1961, subject as to Lots 143, 144, 523, and 533 to 536 (inclusive) and Lots 394, 395, and 396, D.P. 20512, to a building-line restriction imposed by Notice No. 450029, Canterbury Land Registry.

Agreement for Grant of Easement in Favour of Reginald Henry Whiteman, of Mangaroa, Farmer, over Land in Blocks XIV and XV, Akatarawa Survey District, Taken for a Portion of the Wellington-Napier via Woodville Railway (Portion of Rimutaka Tunnel Deviation), Assented to

WHEREAS, by a Proclamation dated the 4th day of July 1957, and published in Gazette, 11 July 1957, Volume II, page 1282, an area of land containing 19 acres 1 rood 26 perches situated in Block XIV, Akatarawa Survey District, being part land on D.P. 9910, being part Sections 298 and 299, Hutt District, was taken for a portion of the Wellington-Napier via Woodville Railway (portion of Rimutaka Tunnel deviation) : And whereas, Reginald Henry Whiteman, of Mangaroa, farmer, being the registered proprietor of the said land at the date the said Proclamation took effect is entitled to compensation for his interest in the said land: And whereas, the Minister of Works agreed to grant and the said Reginald Henry Whiteman agreed to accept, a right of way over the said land, in part satisfaction of the compensation aforesaid:

Now, therefore, the Minister of Works hereby gives notice, pursuant to section 97 of the Public Works Act 1928, that he assents to the agreement hereinbefore referred to.

Declaration That Land is a Public Reserve

Pursuant to the Reserves and Domains Act 1953, the Minister of Lands hereby notifies that the following resolution was passed by the Rotorua County Council on the 27th day of June 1961:

“That, in exercise of the powers conferred on it by section 13 of the Reserves and Domains Act 1953, the Rotorua County Council hereby resolves that the piece of land vested in the Chairman, Councillors, and Inhabitants of the said county and described in the Schedule hereto shall be and the same is hereby declared to be a public reserve for the purpose of public recreation and erection of public amenities within the meaning of the said Act.”
