Authorising the Laying Off of a Street in the City of New Plymouth, Subject to a Condition as to the Building Line

At the Government House at Wellington this 1st day of November 1961

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the New Plymouth City Council to permit the laying off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft, but not less than 40 ft, subject to the condition that no building or part of a building shall at any time be erected on Lots 134, 135, 136, 142, 143, and 144 of a subdivision of the land shown edged green on the plan marked M.O.W. 3982 referred to in the said Schedule within a distance of 15 ft from the side line of the said street.

TARANAKI LAND DISTRICT

That proposed street in the City of New Plymouth containing by admeasurement 1 rood 8 perches, more or less, being part Section 847 and part Maori Reserve No. 1, Grey District; as the same is more particularly delineated on the plan marked M.O.W. 3982 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Wellington City Council to permit the laying off of the proposed street described in the Schedule hereto at a width of less than 66 ft but not less than 40 ft, subject to the condition that no building or part of a building shall at any time be erected on Lots 2 to 12 of a subdivision of the land shown edged green on the plan marked M.O.W. 4051 referred to in the said Schedule within a distance of 13 ft from the side line of the said street.

That proposed street situated in the City of Wellington, Wellington R.D., containing 2 roods 4Β·38 perches, being part land on Plan A/128, being part Section 35, Karori District; as the same is more particularly delineated on the plan marked M.O.W. 4051 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Authorising the Laying off of a New Street off Forbury Road in the City of Dunedin, Subject to a Condition as to the Building Line

At the Government House at Wellington this 1st day of November 1961

His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Dunedin City Council to permit the laying off of the proposed new street described in the Schedule hereto at a width for parts of its length of less than 66 ft, but not less than 40 ft, subject to the condition that no building or part of a building shall at any time be erected on Lots 1 to 13 inclusive of a subdivision of the land shown edged green on the plan marked M.O.W. 3976 referred to in the said Schedule within a distance of 15 ft from the side line of the said new street.

OTAGO LAND DISTRICT

That proposed street in the City of Dunedin containing by admeasurement 3 roods 10 perches, being parts of Sections 48 and 47, Block VII, Town District; as the same is more particularly delineated on the plan marked M.O.W. 3976 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Varying a Condition as to Setting Back the Building Line of the Land Fronting Part of the South-eastern Side of Grosvenor Street, in the City of Dunedin, Imposed by Memorandum of Acceptance Under Section 128 of the Public Works Act 1928

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to section 131 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the memorandum of acceptance dated the 24th day of February 1958 and deposited in the Land Registry Office at Dunedin as No. X. 19621, exempting Grosvenor Street in the City of Dunedin from the provisions of section 128 of the Public Works Act 1928, subject to a condition as to the building line, by varying the condition with regard to the building line imposed by the said memorandum of acceptance, so that no building or part of a building shall at any time be erected on part Lot 1, D.P. 7639, and Lot 1, D.P. 9209, being parts Section 11, Block VII, Town District, being part certificate of title, Volume 411, folio 7, and Volume 405, folio 136, Otago Land Registry, within a distance of 9 ft 9 in. from the side line of the said street.
