Appointing a Temporary Town Clerk and Treasurer of the Te Karaka Town Council and Conferring Certain Powers of that Council on the Waikohu County Council

COBHAM, Governor-General

PURSUANT to the Municipal Corporations Act 1954, His Excellency the Governor-General hereby makes the following provisions with respect to the discharge of the functions of the Te Karaka Town Council (in this Warrant referred to as the Town Council) within the Town District of Te Karaka (in this Warrant referred to as the town district):

  1. John Alexander Geard, the County Clerk of the Waikohu County Council, is hereby appointed the Town Clerk and Treasurer of the Town Council of the town district. This appointment shall, unless sooner revoked, continue in force until the 31st day of December 1962.

  2. Subject to a prior resolution of the Waikohu County Council approving any such payment, the Treasurer of the Town Council is hereby authorised to pay any account lawfully incurred in the name of the Town Council, or make any other payment which is lawfully a liability of the Town Council, and where payment is to be made by cheque drawn on any bank account of the Town Council, that cheque shall be countersigned by any Councillor of the Waikohu County Council authorised by that Council to sign cheques drawn on that bank account.

  3. The Waikohu County Council is hereby authorised and empowered to exercise, in the name of and on behalf of the Town Council, all or any of the powers of the Town Council to make and levy rates that may be exercised by the Town Council under the Municipal Corporations Act 1954 or any other Act, and the said County Council may apply the proceeds of any such rates so made and levied to any purpose to which those proceeds could lawfully have been applied by the Town Council.

  4. The Waikohu County Council is hereby authorised and empowered to enforce any bylaw lawfully made by the Town Council and in force in the town district at the date of this Warrant as if that bylaw was a bylaw of the said County Council.
