THE RIGHT HON. KEITH HOLYOAKE PRESIDING IN COUNCIL
PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolution passed by the Wellington City Council on the 19th day of April 1961, and set out in the First Schedule hereto, in so far as it affects the side and portion of street described in the Second Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on the said land within a distance of 25 ft from the centre line of the said street.
FIRST SCHEDULE
THE Wellington City Council, being the local authority having control of the streets in Wellington City, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the southern side of the portion of Cecil Road adjoining Lot 10, D.P. 812, being all (or part) of the land in certificate of title, Volume 92, folio 129, Wellington Registry, as is more particularly shown on the plan annexed hereto.
SECOND SCHEDULE
WELLINGTON LAND DISTRICT
ALL that piece of land containing 39 perches situated in the City of Wellington, Wellington R.D., being Lot 10, D.P. 812, being part Sections 5 and 6, Wadestown. All certificate of title, Volume 92, folio 129, Wellington Land Registry.

Authorising the Laying Off of Kensington Mews in the City of Palmerston North, Subject to Conditions as to the Building Line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Palmerston North City Council to permit the laying off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft, but not less than 40 ft, subject to the condition that no building or part of a building shall at any time be erected on Lots 1 to 7 and Lots 9 to 12 (all inclusive), and Lot 14 of a subdivision of the land shown edged green on the plan marked M.O.W. 3601 referred to in the said Schedule within a distance of 13 ft from the side line of the said street or on Lots 15 and 20 of the said subdivision within a distance of 10 ft from the side line of the said street.

WELLINGTON LAND DISTRICT
THAT proposed street in the City of Palmerston North containing by admeasurement 1 rood 39Β·42 perches, more or less, being part Lot 6, D.P. 7051, and part Lot 1, D.P. 13611, being part Section 1083, Town of Palmerston North, and part Hokowhitu No. 5; as the same is more particularly delineated on the plan marked M.O.W. 3601 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Murupara Cemetery Order 1961

PURSUANT to the Cemeteries Act 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER
- (1) This order may be cited as the Murupara Cemetery Order 1961.
(2) This order shall come into force on the 1st day of October 1961. - The Murupara Town Council is hereby appointed to be the trustee of the Murupara Cemetery, being the area described in the Schedule hereto, and shall have the control and management of that cemetery under and for the purposes of the Cemeteries Act 1908.
- The delegation to the Whakatane County Council of the powers of appointing and removing trustees of the said cemetery, made by the Murupara Cemetery Order 1960,* is hereby revoked.
- The Murupara Cemetery Order 1960* is hereby revoked.
SCHEDULE
MURUPARA CEMETERY
ALL that area in the South Auckland Land District containing 15 acres and 28 perches, more or less, being Section 67, situated in Block XIII, Galatea Survey District, and being the whole of the land comprised and described in the plan numbered S.O. 40160 held in the office of the Commissioner of Crown Lands, Hamilton.

PURSUANT to the Cemeteries Act 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER
- (1) This order may be cited as the Sandy Bay Cemetery Order 1961.
(2) This order shall come into force on the 1st day of October 1961. - The Waimea County Council is hereby appointed to be the trustee of the Sandy Bay Cemetery, being the area described in the Schedule hereto, and shall have the control and management of that cemetery under and for the purposes of the Cemeteries Act 1908.
- The delegation to the Waimea County Council of the powers of appointing and removing trustees of the said cemetery made by Order in Council dated the 11th day of August 1930* is hereby revoked.
- The said Order in Council is hereby revoked.
SCHEDULE
SANDY BAY CEMETERY
ALL that area in the Nelson Land District containing 2 roods 4 perches, more or less, being part Section 29, Square No. 9, Block VIII, Kaiteriteri Survey District.
