Varying a Condition as to Setting Back the Building Line of the Land Fronting Portion of Centennial Avenue in the City of Dunedin, Imposed by Order in Council Under Section 31 of the Municipal Corporations Amendment Act 1948 and Section 125 of the Public Works Act 1928

ORDER IN COUNCIL

At the Government House at Wellington this 5th day of July 1961

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to section 131 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 6th day of December 1949, published in Gazette, 8 December 1949, Volume 3, page 2779, and deposited in the Land Registry Office at Dunedin as No. 5880, authorising the laying off of the streets described in the Schedule of the said Order in Council, subject to a condition as to the building line, by varying the condition with regard to the building line imposed by the said Order in Council so that no building or part of a building shall at any time be erected on the land fronting the portion of the street described in the Schedule hereto within a distance of 15 ft from the side lines of the said portion of street.

Otago Land District

PORTION of that street in the City of Dunedin known as Centennial Avenue; as the same is more particularly delineated on the plan marked M.O.W. 3028 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Authorising the Laying Off of Athlone Place in the City of Palmerston North, Subject to Conditions as to the Building Line

ORDER IN COUNCIL

At the Government House at Wellington this 5th day of July 1961

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Palmerston North City Council to permit the laying off of the proposed street described in the Schedule hereto of a width for part of its length of less than 66 ft, but not less than 40 ft, subject to the condition that no building or part of a building shall at any time be erected on Lots 8 to 17 (inclusive) of a subdivision of the land shown edged green on the plan marked M.O.W. 3092 referred to in the said Schedule within a distance of 13 ft from the side line of the said street or on Lots 2 and 3 of the said subdivision within a distance of 10 ft from the side line of the said street.

THAT proposed street in the City of Palmerston North containing 1 rood 20·12 perches, more or less, being part Lots 184 and 233, D.P. 791, part Hokowhitu No. 2; as the same is more particularly delineated on the plan marked M.O.W. 3092 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
