PARTICULARS OF THE SAID SCHEME

The Taranaki Hospital Board or the trustee or trustees for the time being of the above-named estate shall hereafter hold the funds held upon the aforesaid trusts together with the investments and securities for the time being representing such funds and also the interest accruing thereon (such funds, investments, securities, and interest being hereinafter referred to as “the trust fund”) upon the following trusts, that is to say, upon trust:

(i) To invest the trust fund in any of the investments for the time being authorised by the law of New Zealand.

(ii) To pay out of the trust fund a sum or sums not exceeding in the whole £15,000 for the purpose of erecting and providing a chapel for all Christian denominations at the Board's Westown Hospital, together with adequate fittings, fixtures, furnishings, and furniture therefor, for the use of the patients and members of the staff at the said hospital, and such other persons or classes of persons as may from time to time be approved by the Board, such chapel to be either a separate building or part of any hospital building as the Board may decide.

(iii) To stand possessed of the balance of the trust fund, upon trust in the first place, to appropriate and set apart thereout the sum of £8,000 (hereinafter together with the income thereof called “the annuity fund”), and to invest the annuity fund in any of the investments authorised by the law of New Zealand, and to pay out of the capital or income of the annuity fund to Royce Oscar Ulander, of New Plymouth, pensioner, the annual sum bequeathed to him in and by the said will in the manner provided therein.

(iv) To pay out of the residue of the trust fund the reasonable costs and expenses of all parties of and incidental to preparing and perusing this scheme and submitting the same for the approval of the Attorney-General and to the proceedings in the Supreme Court in connection therewith.

(v) To apply from time to time the residue of the trust fund and after the death of the said Royce Oscar Ulander the balance remaining of the annuity fund for any one or more of the following purposes:

(a) The provision and maintenance of such cultural and recreation facilities for the use of of the staff of any institution or institutions under the control of the Board as would be likely to improve the efficiency of the staff as such and assist the recruiting of staff, and as may be recommended by the Board and approved by the Minister of Health.

(b) For any other charitable purpose recommended by the Board and approved by the Minister of Health and the Attorney-General and also by the Court:

Provided that no part of the trust fund or annuity fund shall be applied so as to exonerate or relieve the public funds from any charge or expense which but for such application would be incurred.

The said scheme and the Attorney-General’s report thereon have been filed in and may be inspected at the office of the Supreme Court at New Plymouth. The date proposed for the hearing of the application to approve the said scheme is the 1st day of August 1961.

Any person desiring to oppose the said scheme is required to give written notice of his intention to do so to the Registrar of the Supreme Court at New Plymouth and to the said trustees whose address for service is at the office of Messrs Nicholson, Kirkby, Sheat, and Ewart, Devon Street, New Plymouth, and to the Attorney-General not less than seven clear days before the said date proposed for the hearing of the application.

The price of each Gazette varies and is printed thereon. The New Zealand Gazette is published on Thursday evening of each week, and notices for insertion must be received by the Government Printer before 12 o'clock of the day preceding publication.

Advertisements are charged at the rate of 9d. per line for the first insertion, and 6d. per line for the second and any subsequent insertions.

The number of insertions required must be written across the face of the advertisement.

All advertisements should be written on one side of the paper, and signatures, etc., should be written in a legible hand.

STATUTORY REGULATIONS

Under the Regulations Act 1936, statutory regulations of general legislative force are no longer published in the New Zealand Gazette, but are supplied under any one or more of the following arrangements:

(1) All regulations serially as issued (punched for filing) subscription £2 per calendar year in advance.

(2) Annual volume (including index) bound in buckram, 35s. per volume. (Volumes for years 1936-37 and 1939-42 are out of print.)

(3) Separate regulations as issued. The price of each regulation is printed thereon.
