Authorising James Martin Robertson, of Takaka, Farmer, to Use Water for the Purpose of Generating Electricity and to Erect Certain Electric Lines, and Revoking a Previous Licence

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to James Martin Robertson, of Takaka, farmer (hereinafter referred to as the licensee), a licence, subject to the conditions hereinafter set forth, to take and use from an unnamed stream (hereinafter referred to as the said stream), situated in Section 2, Block III, Totaranui Survey District, in the County of Takaka, for the purpose hereinafter set forth, a stream of water not exceeding 1 cubic foot per second at any one time and to lay, construct, put up, place, and use the electric lines hereinafter described; and further hereby revokes the Order in Council dated the 31st day of October 1940, and published in the Gazette on the 7th day of November 1940, at page 3138, authorising Laurence Manson, of Takaka, farmer, to use water for the purpose of generating electricity and to erect certain electric lines.

CONDITIONS
IMPLIED CONDITIONS
- The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.
LICENCE SUBJECT TO REGULATIONS
- This licence is issued under the Water Power Regulations 1934, and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1958, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.
UTILISATION OF WATER AND LOCATION OF HEADWORKS
- Water shall be used under this licence solely for the purpose of generating electricity and shall be taken from the said stream at a point in Section 2, Block III, Totaranui Survey District, indicated on the plan marked P.W.D. 108063 deposited in the office of the New Zealand Electricity Department at Wellington.
GENERAL DESCRIPTION OF WORKS
- The licensee is hereby authorised, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being indicated on the said plan P.W.D. 108063.
(a) Headworks consisting of a weir and intake with a water race and pipeline leading to the powerhouse hereinafter referred to, giving a static-head of approximately 160 ft.
(b) Powerhouse with all necessary equipment for generating electricity, situated in part Section 1 of 11, Block III, Totaranui Survey District.
(c) Electric lines leading from the said powerhouse as follows:
(i) In a northerly direction across a public road and the said stream to a worker’s dwelling in Section 21; and
(ii) In a north-westerly direction across a public road to the licensee’s dwelling in Section 1 of 11.
All being situated in Block III, Totaranui Survey District, the said lines being shown by means of broken white lines on the said plan P.W.D. 108063.
SYSTEM OF SUPPLY
- The system of supply shall be as described in paragraph (d) of regulation 21–01 of the Electrical Supply Regulations 1935, and shall be a direct-current system.
DURATION OF LICENCE
- Unless sooner lawfully determined this licence shall continue in force until the 31st day of March 1981 or until electrical energy is available from an Electric Power Board or other public source of supply, whichever is earlier.
RENTAL
- For the purpose of assessing the rental or annual sum payable in respect of this licence, the maximum generating capacity of the plant at the commencement of this licence is 10 kilowatts.
NO RIGHT TO WATER CONFERRED
- Nothing in this licence shall of itself confer upon the licensee any right to water.

Amending an Order in Council Authorising the Chatham Islands County Council to Erect and Use Certain Electric Lines

At the Government House at Wellington this 30th day of November 1960

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 25th day of January 1955, and published in the Gazette on the 3rd day of February 1955 at page 105, authorising the Chatham Islands County Council to erect and use certain electric lines, by deleting the Schedule thereto and substituting the following Schedule therefor.

SCHEDULE
LINES for the supply of electrical energy by the system of supply hereinbefore described, commencing from the licensee’s generator situated adjacent to a public hall and proceeding in a north-easterly direction along Te Ngiao Road to its junction with the Waitangi-Owenga Main Highway and thence:
(a) In a south-easterly direction along the Waitangi-Owenga Main Highway to a street light.
(b) In a north-westerly direction along the Waitangi-Owenga Main Highway to its junction with the wharf access road and thence in a north-westerly direction along the wharf access road to a wharf.
All being situated in Kekerione part 66 Block, Block II, Oropuke Survey District, in the County of Chatham Islands, the said lines being more particularly shown by means of red and blue lines on the plan marked N.Z.E.D. 555 deposited in the office of the New Zealand Electricity Department at Wellington.

Altering the Boundaries of Urewera National Park

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 10 of the National Parks Act 1952, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby alters the boundaries of the Urewera National Park by excluding therefrom the land described in the Schedule hereto.

PURSUANT to section 175 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the Manukau County Council to reclaim from the sea at Tamaki River the land coloured red on plan marked M.D. 10908 and deposited in the office of the Marine Department at Wellington.
