In the matter of the Companies Act 1955 (section 209) and in the matter of Russell and Co. Ltd.
NOTICE is hereby given that a petition for an order:
(a) Directing that the chairman of directors vacate his office as chairman of directors and as a director;
(b) Appointing a new chairman of directors or directing the appointment of a new chairman by the remaining directors or by the shareholders and fixing the manner of such appointment;
(c) Directing that the petitioner may purchase the shares or some of the shares of other shareholders, fixing the number of shares to be transferred accordingly, and directing how the price is to be fixed and the manner and times of payment;
(d) In addition to or as an alternative to (c), directing that the petitioner be appointed manager or managing director of the company for such time, at such remuneration, and generally upon such lines as the Court thinks fit;
(e) Reducing or increasing the number of directors, altering the qualifications of directors, and making such other order as seems fit and likely to ensure the more efficient and fair conduct of the company’s affairs by the directorate and the officers of the company;
(f) Altering the articles of association accordingly;
(g) Dealing with costs of the petition,
or for such other order as shall be just, was presented to the Supreme Court on the 4th day of October 1960 by William Smith Russell, of 10 Tennyson Street, Christchurch, salesman; and that the said petition is directed to be heard before the Court sitting at Christchurch on the 2nd day of November 1960, at 10 a.m.; and any creditor or contributory of the said company desirous to support or oppose the making of an order on the said petition may appear at the time of the hearing in person or by his counsel for that purpose; and a copy of the petition will be furnished by the undersigned to any creditor or contributory of the said company requiring a copy on payment of the regulated charge for the same.

The notice must state the name, address, and description of the person or, if a firm, the name, address, and description of the firm, and an address for service within 3 miles of the office of the Supreme Court at Christchurch, and must be signed by the person or firm, or his or their solicitor (if any), and must be served or, if posted, must be sent by post in sufficient time to reach the above-named petitioner’s address for service not later than 4 p.m. on the 1st day of November 1960.

Notice is hereby given, pursuant to section 405 of the Companies Act 1955, that S. Oppenheimer and Co. Inc., duly incorporated in West Virginia, U.S.A., and having its Head Office for New Zealand at 208A Lambton Quay in the City of Wellington, intends to cease to have a place of business in New Zealand on the expiration of three months from the date of publication of this notice.

ROTORUA COUNTY COUNCIL
NOTICE OF INTENTION TO TAKE LANDS FOR THE PURPOSES OF AN AERODROME
In the matter of the Counties Act 1956 and the Public Works Act 1928.
NOTICE is hereby given that the Rotorua County Council proposes, under the provisions of the above-mentioned Acts, to execute a certain public work, namely, the provision of an aerodrome in the County of Rotorua; and for the purposes of such public work the lands described in the Schedule hereto are required to be taken; and notice is hereby further given that a plan of the lands so required to be taken is deposited in the public office of the Clerk to the above Council and situated at the corner of Ranolf and Amohau Streets, Rotorua, and is open for inspection, without fee, by all persons during ordinary office hours.
All persons affected by the execution of the said public work or by the taking of such lands who have any well grounded objections to the execution of the said public work or to the taking of such lands must state their objections in writing and send the same, within 40 days from the first publication of this notice, to the County Clerk at the Council Chambers at the corner of Ranolf and Amohau Streets, Rotorua. (Postal address, P.O. Box 5028, Rotorua South.)
